Original porch details should not be replaced with materials representing a different period or style from the original. <br />STAFF RECOMMENDATION: Staff does not recommend replacing trim with new artificial product and does not recommend <br />the change in style that deviates from the original. Staff does not recommend replacement windows. <br />Elicia Feasel, Executive Director <br />Board requested owner to sign waiver to extend COA for continued investigation to allow staff to <br />evaluate those elements of the project that currently have insufficient information to make a <br />determination; owner agreed. <br />Commissioner Buccellato moved to approve conditionally A, E, and F as submitted, along with <br />all windows that have been replaced to date; items B, C, and D are continued subject to review by <br />staff. Seconded by Commissioner Gordon. Five in favor, none opposed. <br />Vote: 5 — 0. <br />COA92016-0401 Approved with Conditions, with items B, C, and D subject to continued <br />deliberation. <br />B. LOCAL LANDMARK DESIGNATION <br />1. First reading: 803 West Washington Street <br />No public input at first reading <br />III. HEARING OF VISITORS <br />A. Jim Bognar, 807 West Washington Street — Clarified that Rafael Morton attended the <br />March 21, 2016 HPC meeting by his personal invitation in support of Mr. Bognar's claims <br />regarding the 803 West Washington Street Fagade-Easement. Mr. Bognar continued with the <br />assertion that Mr. Morton's attendance at the March meeting was misconstrued by certain <br />members of the public and that has created great concern for Mr. Morton. Further discussion <br />on HPC Executive Director's letter to the "Street Renaming Advisory Committee" and South <br />Bend Tribune editorial regarding the renaming of Chapin Street; also concerns with 803 West <br />Washington proposed landmark designation. Mr. Bognar later interjected to offer his <br />apologies to Executive Director Feasel, the Historic Preservation Commission and to Todd <br />Zeiger of Indiana Landmarks for "any misconceptions that (he) could have created to make <br />their life more difficult." <br />B. Rafael Morton, 325 North Studebaker — Addressed the HPC Commission Board on <br />perception that he was at the March 21St meeting for purpose of Chapin Street discussion. Mr. <br />Morton discussed at least one disturbing telephone conversation he had with an undisclosed <br />individual regarding the Chapin Street re -naming discussion and his purpose for attendance at <br />the March meeting. HPC Executive Director Elicia Feasel disclosed that nine individuals <br />signed the public ledger guest book for the March meeting. Later discussion with Mr. <br />Morton: he was unaware that anyone was willing to discuss 803 W Washington easement <br />situation. President Klusczinski informed Mr. Morton of several attempts made by the HPC <br />to initiate a discussion with interested members of the County Council; HPC has not received <br />any response to date. Mr. Morton was unaware. <br />C. Todd Zeiger, Indiana Landmarks, 402 West Washington — Responded to concerns over <br />803 West Washington Street easement transfer. Indiana Landmarks is a certified holder of <br />easements, which are superior to the previous easement which only covered the house. The <br />easement transfer did not cause the sale of the property to collapse. The buyers did not want <br />any regulations at all, and it fell apart when Indiana Landmarks began to assert their <br />covenants. Indiana Landmarks has never been asked to have a conversation about the transfer <br />of the easement, and they would welcome the opportunity to talk about it from their side. In <br />response to question of easement value: Appraiser could give value of property easements <br />(value with easement less value without. Difference is value of easement to donor.) Holder <br />of easement has negative value, as they must hold money to defend future actions. <br />0 <br />
