Owner will have no right of occupancy until full contract price is paid unless LCI expressly <br />consents in writing to possession prior to full payment. <br />6. LCI guarantees all material and workmanship against defect for one (1) year after completion <br />of Work. This guarantee is in lieu of any other guarantees, warranties, or representations, <br />whether express or implied. Normal wear and tear on items such as overhead doors or <br />service doors is not included in terms of this warranty. LCI shall not be liable for any <br />incidental or consequential damages in connection with material or workmanship provided, <br />under this contract. <br />7. LCI has not surveyed the real estate and Owner assumes all responsibility for proper location <br />of building on real estate. In addition, Owner is responsible for correctly locating all <br />easements and rights-of-way and is responsible for any additional costs incurred as result of <br />such easements or rights-of-way. <br />8. LCI shall not be responsible for any delay in or failure to complete Work if such delay or <br />failure is due to any cause or circumstance beyond control of LCI, including, but not limited <br />to, government restrictions and regulations, strikes, fires, accidents, failure or delay of any <br />carrier, financial or monetary crisis, force majeure, acts of God, or weather. <br />9. LCI will maintain insurance to protect it from claims under Workmen's' Compensation Acts <br />and also such insurance to protect it from claims or damages caused by personal injury, <br />including death, and claims for damage to property, arising from operations under this <br />contract, if caused by LCI, its employees, contractors, or subcontractors. Owner shall famish <br />at his own expense, including payment of any deductible amount, builders risk policy <br />including of, but not limited to, fire, extended coverage and vandalism, copy of which will be <br />furnished to LCI. <br />10. LCI shall secure all permits, licenses, and approvals to extent required for Work to be <br />performed by LCI. <br />11. Prior to completion, this contract cannot be terminated without written consent of LCI and <br />Owner. In case of termination, Owner will reimburse LCI for all expenses incurred in <br />performance of this contract, including reasonable profit for work actually performed, prior - <br />to termination of this contract. <br />12. Owner will pay cost of hook-up for all utilities and all monthly utility bills directly to utility <br />companies. <br />13. This contract can only be amended by written agreement signed by both Owner and LCI. In <br />case of changes to scope of Work, written change orders will contain change in contract <br />price, if any, caused by change in scope of Work. <br />
