APPLICATION ITEMS: The letter from the trustee is requesting the following: to move the Daniel Ward <br />Home from its current location (Exhibit A) to a new site immediately to the north (Exhibit B.) and for the <br />Commission to "consider relinquishing the historic site designation for the 260'x1320' parcel ". <br />---"B" LOCAL LANDMARK STANDARDS: E. Moving: The moving of landmarks is discouraged, however <br />moving is preferable to demolition. When moving is necessary the owner of the landmark must apply to the <br />Commission for a Certificate of Appropriateness. <br />RECOMMENDATION: The Staff recommends approval of the move as the new site is sympathetic to the <br />historic placement of the house and its preservation. However, this recommendation is contingent on the moving <br />and/or reconstruction of the buildings from the farm yard that were also landmarked. (Exhibit CZ. There is a <br />precedent for releasing landmark designation of the land in the decision of the Commission on May 21, 2001 <br />(Exhibit D) for land included in the landmarking of 14297 State Road 23. <br />Klusczinski: Is the petitioner present? Again, please state your names and addresses for the <br />record, and you're allowed to make a presentation. <br />Davey: My name is Christopher Davey and I am a real estate broker with Grubb/Ellis Cressy and . <br />Everett with offices at 3930 Edison Lakes Parkway, Mishawaka Indiana. I have with me Tim <br />Lykowski from Lykowski Construction. He'll take any questions about moving houses, he has <br />moved historical houses in the past. If I could I'd like to give you some background. For the past <br />12-15 months., I have been working with Pat, Pat Bauer is the Trustee for the Burnett C Bauer <br />Trust which has title to the property. We have been working with an out of state developer that is <br />interested in acquiring the property. If you know the area at all, you know that when this site the <br />land and the property and all was designated you know that it was a whole different environment <br />than what exists out there today. Today we have shopping centers across the street from us, we <br />have shopping centers east west north and south of us. As part of our due diligence in working <br />with this developer and with the city of Mishawaka, most likely assuming that we would prevail, <br />and not to be presumptuous but should we prevail, Mishawaka is interested in acquiring a little bit <br />more right of way. There intentions are to expand Gumwood or Main Street even more than what <br />exists there today. It is our intention with your permission, to relocate that home approximately <br />1320 feet to the north. If you're familiar with that area, on the west side of Gumwood there's a <br />little road that leads back to two homes that sit to the west of Gumwood. The Bauer family owns <br />a little more than 2000 ft of frontage starting at 23 and going all the way up to the Suzuki Music <br />School if you know where that is. This lane is south of that. It's our intention with your approval <br />to relocate that home to a parcel of land that's about 90 ft of frontage on Gumwood to a depth of <br />about 260 ft east and west. Ninety north and south and 260 east and west. We'll make every <br />effort to move that home as far west or off of Gumwood as allowable. We have met with the City <br />of South Bend, and the parcel that we're intending to move the home to with your permission is <br />currently zoned residential. Today that property is used for a law office and retail business. I <br />believe that it's the intention of the Bauer family, and it could change, but I believe that its their <br />intention that Bernie and his daughter would move into the home and use it as a residence. We're <br />obviously going to have to make some changes to the home from the standpoint of mechanical <br />systems, not architectural or changes to the outside of it. We will make some additional <br />improvements though should we succeed tonight. The offer has been signed and accepted by the <br />Bauer family. It is a conditional contract, we need to get zoning. The property is presently zoned <br />commercial. I think that you have the site from Cleveland about 1320ft. In addition to the <br />historical home on the corner, there's another residence there and then Matt, Pat's brother, built <br />the soft water business there immediately north of this property. We think it's a much better <br />location. I'm not sure of the protocol tonight so I'd like to reserve the right to ask some questions <br />if we get into some stuff that I'm not sure of. I also think that there might be some state, is there <br />a state...? <br />Hostetler: There's state designation. But that only requires a letter. <br />Davey: So if we would prevail, we'd send a letter to them asking them to make that change as <br />well? Ok. There is some question too.
