Due to a <br />previous obligation out of the country, the petitioner was not able to be present at this meeting. <br />HPC Legal Counsel, Shawn Peterson, was contacted via email by Attorney Robert E. Rodes, <br />representing the petitioner. The petitioner, via Mr. Rodes, requested a continuance of this matter. <br />Commissioners discussed the merits of a continuance, including whether or not a modification <br />suggested conversationally at the previous meeting of the HPC (see Minutes 11/19/2007) had the <br />consent of the petitioner, i.e .... if the petitioner was amenable to modifying his petition as briefly <br />mentioned during the meeting, is it even necessary to continue 2007-1107, or should it be modified <br />to reflect the suggested change. <br />It was determined that the petitioner had not been formally asked to consent to the modification at <br />the meeting of 11/19/2007, nor was the petitioner nor his counsel present at this meeting to consent, <br />therefore consideration of a continuance of 2007-1107 is appropriate. <br />Moved: Ujdak Second: Sporleder <br />To Continue 2007-1107 Approved 5-2 <br />Klusczinski, Patrick dissenting <br />C of A 2007-1107 is continued until the regularly scheduled meeting of the HPC on January 28, <br />2007 (a week later than usual due to MLK holiday) at 7:00 p.m., 13`h floor, County City Building. <br />Any modifications, changes, or addendums to C of A 2007-1107 must be received by staff at <br />or before 12 NOON ON JANUARY 17TH, 2008. <br />B.
