Patrick: So I'd like to have someone make a motion that we approve replacement of the windows <br />contingent on their holding the old windows in basement or safe and secure storage, which is to <br />say that we are effectively denying it unless they do save the windows. And staff shall <br />communicate with them to ensure this is, and advise the Commission if in fact they do not agree <br />to this. Otherwise, we'll consider this matter resolved, contingent upon their accepting our <br />contingency. <br />Choitz: Iso move. <br />Patrick: Do I have a second? <br />Riley: Second. <br />Patrick: All in favor? (Ayes are heard) <br />Sporleder: I would like to abstain. <br />Patrick: We have one abstention. <br />Riley: That's application number 2006-1113? <br />Patrick: Yes. <br />Peterson: We can do the evidence at the next meeting we can evidence their signature on a <br />document that they'll maintain the original windows. <br />Klusczinksi: Wait a minute, I had a denial. <br />Patrick: Ok <br />Klusczinski: I deny the C ofA under that criteria. <br />Patrick: I'm sorry, <br />Klusczinski: Right, we didn't... <br />Patrick- We can do a roll call. <br />Klusczinski: Tim Klusczinski, I deny C ofA 20061113 we have no mechanism to police <br />directives like the storage of original windows and doors when this criteria is bound to the C of <br />A, nor can we guarantee that a future owner might violate these convemants at any time. <br />Therefore, I'd strongly caution any member of this Commission from permitting changes with this <br />appeasement. I deny this C ofA since the petitioner and the application failed to sufficiently <br />prove, tonight, that all nine of the designated windows were beyond repair allowing an exception <br />to the East Wayne guidebook. But the benefits sought by the petitioner could not be achieved <br />through restoration of the existing windows, that the exterior vinyl cladding is an appropriate in- <br />kind alternative to aluminum clad or all wood complements. That the replacements will <br />satisfactorially match the openings, scale and proportion of the existing ones, and that hardship <br />upon this denial is expected. <br />Patrick: Mary Jane? <br />Chase: I approve on the condition that the windows be saved, and that's self-explanatory. If they <br />don't save them, then... <br />Zeiger: Aye. Todd, I voted aye. <br />Patrick: I, Lynn Patrick, vote aye, because I believe that the condition of this house of this house <br />has been sufficiently altered that in this situation this is the most appropriate response. <br />Riley: Linda Riley, I vote aye. <br />Choitz: And I also vote aye, I fully agree with the President. <br />Ujdak: Jerry Ujdak, I vote aye. <br />Sporleder: I'm Joann Sporleder, and I am abstaining. I would like to suggest that all the denials <br />need to state their reasons for denying, however. <br />Zeiger: Why don't you state your reason for why you're abstaining? <br />Riley: Yeah. <br />Sporleder: I don't need to explain why I'm abstaining, I'm abstaining from voting. <br />Peterson: I think that its appropriate to those that voted aye to the motion to state why they <br />desire for the original windows to be kept. In a way, you are denying this if they do not accept <br />that aspect. So you do need to say why you want them to keep that original aspect at least. <br />Patrick: Because that is a stipulation in the guidebooks.
