evidence that they need to support it. The application is vague in regards to what you're asking <br />them to do. What you've done is put this commission which is a legal body in a very difficult <br />position to approve something in which the question presented doesn't necessarily dictate what <br />they approve. It's more of your testimony... that you're revising your application while you <br />speak, and that is very difficult position to put the commission in ... maybe ...inaudible—the <br />application should be withdrawn, and be revised to be a more concise question before the board. <br />GE: As I said I think that there are three objectives here, and one is to preserve the... <br />LP: I'm going to interrupt for a second here, you have stated that, and I understand that. We're <br />also under a time deadline and we've exceeded by several term our normal time deadline.... <br />JS: I'd like to suggest, unless time is of the essence for you, that you prepare three cross sections, <br />similar to this, which would illuminate the three options that you're looking at. The original <br />cross section, including the trim, the inside, the outside what the cross section would look like <br />with storm windows, and what the cross section would look like with replacement windows, to the <br />extent that they can be measured, so that we can make a comparison. Trails off to inaudible. <br />LP: I'm going to suggest that we, as the counselor suggested that we should have this withdrawn, <br />clarified and resubmitted. <br />SP: As a body, you really can't ask that it be withdrawn, it must come from the petitioner. You <br />can deny it... <br />LP: I understand. Do you wish to withdraw your petition? <br />GE: May I ask... may I submit it again? <br />LP: By all means, at the next meeting that's in one month. And if...what is your time constraints <br />on this, are you planning any international travel? <br />GE: Actually yes, tomorrow I have to go to Shanghai. <br />LP: You have extensive Chinese connections in your extensive resume. <br />GE: In that case, I will withdraw my proposal and resubmit it with those three cross sections' in a <br />month. <br />LP: Where you planning on having this work done while you were in Shanghai? <br />GE: Well, I will be back pretty quickly. I think that I can manage that. <br />LP: I would also recommend that you work with Historic Preservation Commission so that when <br />it is resubmitted everything has the clarity that we can make an effective and legal ruling on it. <br />From mark 884-886 on tape, conversation is inaudible <br />LP: I would also recommend when you're back from Shanghai that you call the Commission and <br />let us know that you're back in town. We'll do everything that we can to move this forward. <br />GE: Thank you. <br />LP: Thank you so much for coming. I saw a raised hand in the audience. <br />JK: I'm Joanie Downs Krostenko, 849 Forest Avenue. I actually came with a statement that I <br />wanted to read apropos of the C ofA for 710 Park Avenue, which I would like to leave whether I <br />am allowed to read it or not. I do also wish to ask a question as a member of the audience. I <br />understand that the C ofA as written was somewhat vague or contradictory but even in the <br />audience, regardless of that contradiction, it was not clear to me whether or not it was a C ofA <br />for the restoration or replacement of the existing windows or regarding the addition of storm <br />windows. And I was just wondering if that could be cleared up, because it seemed like if he was <br />given the right to do replacement windows, then he wasn't going to need storm windows, is that <br />right? So is it appropriate for me to make my statement regarding this C ofA? <br />LP: Actually, I mentioned public hearing, and I didn't see anyone in the audience <br />JK: Yes, that was me.
