terms that he needed to have a building permit. There was no doubt in his mind what I
told him. I don't know how he managed to confuse that; but, that is exactly what I told
him.
DIANA MATTHIAS: I am afraid that I didn't know.
JOANN SPORLEDER: They were painting the house in July?
WAYNE DOOLITTLE: No, this was after the Doric capitals were put in. The painters
were there; they were finishing putting some of the molding on it. They asked me if they
should stop painting, and I said no, continue painting because you want to protect the
wood that is there. We do not have authority over painting. What I was speaking of was
the replacement of the Scamozzis and what they had to do and there are requirements by
the city that require him to get a building permit.
JOANN SPORLEDER: What was the date that this exchange happened with the
contractor, approximately?
WAYNE DOOLITTLE: I don't know when that particular conversation was. It was in
September, I believe. It was whenever you were having the columns finished.
DIANA MATTHIAS: I think that was October.
JOANN SPORLEDER: With what you had said was that somewhere in that particular
thing then you were alerted to applying for a C of A, which is why we have it in front of
us now.
DIANA MATTHIAS: Yes.
JOANN SPORLEDER: You did apply for a C of A when you were made aware that
you were supposed to do that.
DIANA MATTHIAS: As soon as we knew about it we applied for it, yes indeed.
JOANN SPORLEDER: That was in October?
DIANA MATTHIAS: Yes.
JOANN SPORLEDER: This is why it is on our November agenda.
DIANA MATTHIAS: Yes. I hope you see why we didn't apply for the C of A at the
time we should have, because we didn't know about it and I can quite say we should have
known about it; but, with one thing and another we didn't. It was not a rejection of this;
we certainly would have applied for it had we known about it.
LYNN PATRICK: You prefer the Doric capitals, then?
DIANA MATTHIAS: Yes I do.
MARY JANE CHASE: You stated that Mr. Dierbeck has been working for you for
over twenty years?
DIANA MATTHIAS: Yes.
MARY JANE CHASE: In that amount of time he never was aware that he needed a
building permit. If he has been a contractor for that many years he would know that he
would need a building permit.
DIANA MATTHIAS: I am afraid I don't know what he knows and what he doesn't
know.
MARY JANE CHASE: A contractor would have to know this and I think he would
have to be licensed too.
DIANA MATTHIAS: I asked him this last night and he was under the impression that
the work that he was doing on our porch wasn't structural enough to require a building
permit and I didn't know what the differences were between what was required for a
building permit and what was not.
10
