CHERYL GREENE: What you would want to do is have your legal council involved <br />with any contract negotiations and provide direction as to what the commission exactly <br />would like. What type of services would you like this organization to provide to you and <br />with the dollar amount that they have put into this contract I think you have the right to <br />ask them on what is that fee based and also ask for an itemized accounting. Again, I look <br />at this as an agreement that has been presented to you and this is only the open dialogue. <br />You should negotiate whatever terms are most favorable to you and whether or not you <br />need all of these services or whether you need less. I mean it is entirely what the <br />commission's preference is. If you set a price do you want to then provide the <br />opportunity for a renewal for the following year without having to renegotiate an <br />agreement with a agreed upon increase in that contract. Another way you can look at <br />things is do you want to break things down so that there is an incentive to either reduce <br />costs for the commission or to provide the additional services for which they ought to get <br />an amount. As legal council I would say to you this just opens your discussion and that <br />before you go to agree on a contract you certainly ought to have in your own mind how <br />much you want to budget towards something like this and what type of services you <br />want. You can then provide your legal council with the authority to negotiate favorable <br />terms. <br />Commission members decide to wait until their legal council, Mr. Livingston, came back <br />from his trip before they set up a date to meet with HLFI and Bob Yapp to go over the <br />terms of the proposed contract. <br />VI. HEARING OF VISITORS <br />Don Sporleder mentioned that the commission should act quickly to include an underpass <br />for the Leeper Park Bridge for a bike trail. On March 151 there is going to be a meeting in <br />Elkhart about the St. Joseph Valley River Trail. There will also be a charette in June <br />about Northern Indiana Greenways. <br />VII.
