choose to wait until you have received the complete petition and the evidence that the
petitioner intends to present to you, or if you wish to make a field trip on your own prior
to that point in time; that is entirely within your scope of authority.
JOHN OXIAN: But, you don't have to fulfill every one of those requirements.
CHERYL GREENE: No, it really comes down to a matter of looking at all of those
factors. Some of those factors may not apply; just as when you designate something as a
landmark in the first place it may not apply to that particular property. What you're
looking at is whether or not the original structure has been altered so substantially or so
significantly as to undermine that original designation that you put on that property in the
first place. Again you're working in a closed universe because while the record from the
original designation holds that landmark designation; the fact is the reason that you're
being asked to consider the petition is because the petitioner's position is that those
factors have now changed.
PHILIP HESCH: The other thing I did want to say was; Wendy really appreciated
meeting you out there and I think she is kind of conflicted on what to do and that's why
we filed this petition. I would think it would be helpful if I can talk to you about your
ideas. It is a blur to her what happened on that day. She didn't really remember a whole
lot about what you would accept and what you wouldn't accept from the original petition.
I think what would be helpful is if I could get a copy of the original landmark statute and
then maybe meet with you, Joann, if you wouldn't mind doing so. I really hate to go
forward with a revocation of this, if there were a way she could work something out so
that she could add onto her house and still be able to make the commission happy as well
as herself.
CATHERINE HOSTETLER: We did send out landmark letters to 414 North Ironwood
and to St. Pauls Lutheran Cemetery on New Road. They called and requested
information about land marking statute for cemeteries. We sent out the information and
we will wait and see what happens.
LYNN PATRICK: Do we have copies of those letters in our meeting packet?
CATHERINE HOSTETLER: No, you do not.
JOANN SPORLEDER: Is this for a private Lutheran cemetery; or just cemeteries in
general?
CATHERINE HOSTETLER: No, this is for St. Pauls Lutheran Cemetery.
III. REGULAR BUSINESS
A. APPROVAL OF MINUTES — (October, 2004 and January, 2005)
JOANN SPORLEDER: I will make a motion that the minutes for October 2004 be
approved.
MARY JANE CHASE: Seconds the motion and it passes unanimously. John Oxian
abstains.
JOANN SPORLEDER: I will make a motion that the minutes for January 2005 be
approved.
MARY JANE CHASE: Seconds the motion and it passes unanimously. John Oxian
abstains.
B. TREASURER'S REPORT
JOHN OXIAN: I looked at January's treasury report and there were hardly any
expenses made. Everything equaled out right. The way the report is set up now, and I
worked with Catherine on this, the report comes out at the end of February and by the
9
