In
JOHN OXIAN: Where are Wayne's pictures?
KAREN HAMMOND-NASH: I didn't send him to take additional pictures; because, we
already had a bunch of pictures. They are in the office for any commissioner who would
like to see them.
The question from Code Enforcement was whether we would consent to the
demolition of the structure since a corner of it has already been demolished. I said no and
stated that we would require the owner to rebuild the garage.
GERALD UDJAK: Is the owner still attorney, Rubin?
KAREN HAMMOND-NASH: Yes,
GERALD UJDAK: He is capable of fixing the garage.
KAREN HAMMOND-NASH: Code Enforcement seemed to think so too. They also
wanted to alert us to the fact that the property was vacant.
The commission will probably remembering issuing a C of A in June, and then
partly tabled, and issued in July of 2002 for the Schaffer home, located at 1402, 1404,
and 1406 Lincolnway East. It is a big grey Queen Anne house with four different kinds
of artificial siding, and six different kinds of windows. The commission for the first time
authorized total replacement for all of the windows, with vinyl windows, and to
completely reside the house.
A week after we approved that C of A, the present holder of the property was
sued by one of his nephews. This made him so angry that he decided not to do any
repairs on the property. He has not done any of the things that he has received
permission for in the past, and he has not renewed his application.
One of the things that make this particular property historic is that a hundred years
ago it was part of the longest running probate court contested will out of the state of
Indiana.
GERALD UJDAK: Does anyone live there?
KAREN HAMMOND-NASH: Yes, The house is divided into five or six apartments, and
most of them or all of them are rented out. The state executor also lives in one of the
apartments.
Code Enforcement has scheduled a hearing for March 11th, 2004 on the 15th floor
of the County -city Building. They are seeking a significant amount of interior repairs
and also a certain amount of exterior repairs. They want us to be aware of what sort of
exterior repairs might be ordered by the hearing referee so that we can, if necessary, issue
a C of A to the city of South Bend to ensure that these repairs are done according to
district standards.
3.
