Fearing Avenue <br />Abingdon, IL 61410 <br />Dear Terry: <br />This letter will serve as a notice of conditions and requirements to the Hart-Parr Oliver <br />Collectors Association ( HPOCA) from the City of South Bend and the South Bend <br />Redevelopment Commission (City) regarding Buildings 46 and 47 of the former Oliver Chilled <br />Plow Works at 533 South Chapin Street in South Bend, Indiana. During our recent conversations <br />and correspondence regarding the potential for the HPOCA to develop an agricultural equipment <br />museum in South Bend, several conditions required for the project to move ahead on the Oliver <br />Plow Works site have been identified by the City. Those criteria are as follows: <br />1. Satisfactory proof by the HPOCA that the organization has the wherewithal and <br />financial capacity to conduct a project of this magnitude; realizing that this <br />brownfield property will need to be renovated to Department of the Interior <br />Standards given its inclusion in a National Register of Historic Places District. <br />2. The City is interested in selling the Building 46/47 property outright or <br />transferring it to a viable user. The City is not interested in a Iona-term obligation <br />to maintain or subsidize the facility or a museum operation. <br />3. A proposal must be made to the South Bend Redevelopment Commission with <br />sufficient time to allow for the execution of a development agreement, which <br />outlines the proposed actions and responsibilities to be taken by all parties <br />involved in the project, and for aesthetic renovation and stabilization work to be <br />completed on the buildings before March 31, 2004. That is, a proposal from the <br />HPOCA must be received by September 2, 2003. The land in the Oliver Industrial <br />Park is being offered for bid on a per -acre basis by the South Bend <br />Redevelopment Commission on April 4, 2003 with bids being due May 2, 2003.
