314 landmarked, there is nothing in writing referring to the landmarking of the land, only the <br />315 house. <br />316 <br />317 JOHN OXIAN: The staff report needs to be read. <br />318 <br />319 DAVID ECKRICH: The farmland in question is also not easily identifiable as <br />320 belonging to Mrs. Risler's house. It is separated to the rear and surrounded by roads and <br />321 developments. <br />322 <br />323 CHERYL GREENE: The staff report that was prepared for this petition relates to <br />324 a Certificate of Appropriateness so the staff will have to write another report relating to <br />325 the landmark criteria. I think that tonight you have presented some issues that have not <br />326 been covered before. As legal consul, I would recommend that you not take any action <br />327 tonight because you need to get an opinion from me. You have a situation here where the <br />328 Commission has the power and authority to designate landmarks, but what we are talking <br />329 about now is property and however, the property was designated is usually by address. If <br />330 you have included all this real estate then it brings up new issues. <br />331 <br />332 JOHN OXIAN: When I wrote these letters, all letters were written by using a <br />333 template. After the letter was sent, I would call every farm asking how much of the land <br />334- they wanted to include in the designation. Possibly, in this, instants there might have <br />335 been a misunderstanding, but, every property has a variation in acreage and all were sent <br />336 the same letter. The misunderstanding could have occurred regarding the fact the <br />337 Commission originally wanted to take in the wooded area and the fields behind may have <br />338 been added by mistake. When Mr. Hardig stated that he came in to compromise, he did <br />339 not come in here to compromise he came in with the opinion to remove all the property. <br />340 <br />341 CHERYL GREENE: I am recommending to the Commission that they hold any <br />342 action on this. I would like the opportunity to go back and review the documents. There <br />343 have been some issues presented tonight that have to be looked at. We have some <br />344 information regarding how the property was designated, I have to look at the minutes <br />345 from the meeting when it was landmarked, I have to look at landmark ordinance that the <br />346 Council passed and I think that other issues related to hardship which the commission <br />347 does consider. I think that there are many issues to be reviewed and that no action should <br />348 be taken tonight. <br />349 <br />350 DORIS RISLER: I only have so many years left to me and we could diddle along <br />351 here forever. The State is going to widen S.R. 23 bringing the road with in fifteen feet of <br />352 my bay window, cutting down all of the trees. <br />353 . <br />354 JOHN OXIAN: The State has to get permission before they can do any work <br />355 affecting historic properties. <br />356 <br />357 RICHARD MORRISON: If the landmark status is retained on the house will it <br />358 enhance the resale of the house? <br />359 <br />M. <br />
