47 <br />48 RICHARD HELMUS: It looks like we are going to lose 35 trees, will they be <br />49 replaced? <br />50 <br />51 JOHN FISHER: There are no plans to replace the trees. We have been able to <br />52 quantify the amount of erosion along the West North Shore Drive portion of the St. <br />53 Joseph River, which shows the bank is eroding away at about a foot per year and is <br />54 starting to undermine the road itself. <br />55 <br />56 MARTHA CHOITZ: Will an attempt be made to replace or repair the wall <br />57 around Leeper Island? <br />58 <br />59 JOHN FISHER: The wall will be repaired in the designated project areas. <br />60 <br />61 JOHN OXIAN: Are you going to do only the first portion of the West North Shore <br />62 project where only ten trees are to be removed or will you go all the way to Lafayette <br />63 Street? <br />64 <br />65 JOHN FISHER: We propose to start at Lafayette and go all the way to the end of <br />66 the proposed project area. <br />67 <br />68 JOHN OXIAN: So the Commissions motion should state that the project would <br />69 start at Lafayette Boulevard. <br />70 <br />71 JOANN SPORLEDER: Do the neighbors know about this project? <br />72 <br />73 JOHN FISHER: The neighbors received notification by the IDNR stating that work <br />74 is being considered for a permit. Those that live on W. North Shore own the land on the <br />75 rivers bank so we need to contact them to obtain a temporary easement to allow us onto <br />76 their property. <br />77 <br />78 JOHN OXIAN: If the land belongs to the property owner, shouldn't the property <br />79 owner be the one applying for this project? <br />80 <br />81 CHERYL GREENE: If I am understanding the discussion properly, you are talking <br />82 about taking an easement over the property owners and then the City or State would own <br />83 the land at the rivers edge, am I correct? <br />84 <br />85 JOHN FISHER: The City would have temporary ownership of the rivers bank until <br />86 the work is completed then it would revert to the owner. There is ownership by the state <br />87 in the bed of the river and by the City in the right-of-way. <br />88 <br />89 CHERYL GREENE: So the City is a property owner in this matter and that is <br />90 why they are bringing it before the Commission. They are going to have to obtain a <br />91 construction easement from the property owners to go over their land to get to the <br />92 riverbank. This situation also refers to a health safety issue. <br />2 <br />
