Honorable Members of the Historic January 26, 2001 Preservation Commission of South Bend & St. Joseph County 227 West Jefferson Boulevard Room 1123 South Bend, IN 46601-1830 Re: Petition/Application by Owner for Release of Historic Landmark Designation The undersigned, Doris Risler, of 14297 State Road 23, Granger, IN 46530, respectfully requests and applies to the Historic Preservation Commission of South Bend & St. Joseph County to release the following described real estate located in ST. Joseph County, Indiana, to -wit: Irregular tract 473.65 feet north side Edwardsburg Highway beginning 1287 feet west of the northeast corner, Section 14-38-3 E, containing 41.66 acres, more or less, and more particularly described as follows, to -wit: A part of the West Half of the Southeast Quarter of Section 14, Township 38 North, Range 3 East, St. Joseph County, Indiana, to wit: Beginning at a point on the North line of said Southeast Quarter of said Section 14 which is 1287 feet West of the Northeast corner of the Southeast Quarter of said Section 14; thence West along the North line of said Southeast Quarter of said Section 14, a distance of 926 feet; thence South 1880.4 feet more or less to a point which is 707.6 feet North of the center line of Edwardsburg Highway; thence East 541.6 feet; thence South 341.2 feet to the center of Edwardsburg Highway; thence Northeasterly along the centerline of Edwardsburg Highway, a distance of 473.65 feet; thence North 1945 feet to the place of beginning. Applicant requests that Ordinance No. 94-76 designating and establishing a historical landmark under Ordinance No. 154A-1973, as amended, be terminated. In support of this Petition/Application the Applicant states that the understanding confirmed by writing on May 18, 1976 to Mr. John Oxian of Historic Preservation Commission was that the home of the Applicant be declared a landmark in St. Joseph County, Indiana. Your Applicant at no time understood nor agreed that all of Applicant's real estate, part of which is located the residential dwelling, be given a historic preservation designation.
