Edward Talley, Executive Director <br />Your properties at 129 and 127 Franklin Place and 407 W. Jefferson in South Bend, Indiana are Local Land- <br />marks and as such fall under the jurisdiction of the Historic Preservation Commission {HPC} and the Land- <br />mark Guidelines. The Commission sent the letter dated August 14, 2000 regarding repairs to 127 Franklin <br />Place simply to find out if this problems were going to be addressed and to ensure that you were aware that the <br />property may be sited by Code Enforcement. Code Enforcement went through a change of administration dur- <br />ing the spring and summer and as such failed to notify us that they had sited your property. If we had known <br />this the letter we sent would have simply been to notify you that permits for exterior work would be needed <br />and that we would work with you to address Codes issues. HPC will assume that Mr. Pocza was not aware at <br />that time that these properties were Landmarks and that is why he did not come to us with his rehabilitation <br />plan for 127 Franklin. The Commission has since requested a list of violations from Code Enforcement and a <br />repair plan from Mr. Pocza. We are currently awaiting both documents. <br />The main concern of this letter is 129 Franklin Place. It came to our attention on August 17, 2000 that work <br />was being down to the front porch without the proper permits. Our records indicate that your property man- <br />ager, Frank Pocza, called HPC office on August 11, 2000 to discuss a minimum maintenance letter you re- <br />ceived regarding 127 Franklin Place. During the ensuing conversation the Staff informed Mr. Pocza that any <br />work done to the exterior of either of these three landmarked properties would have to be approved by HPC. <br />Mr. Pocza indicated that he was planning to do rehabilitation work to the front porch of 129 Franklin because <br />of its deteriorating condition. He never mentioned anything about 127 Franklin being sited by code nor did he <br />mention any specifics about possible repairs to the exterior. The staff discussed 129 Franklin with Mr. Pocza <br />at which time he was told if the work to be done looked identical to the existing porch the Staff could approve <br />the needed permit immediately.
