• E. Staff Reports <br />1. C of A Staff Approvals <br />a. 1007 Hudson Av. (RSD) - in-kind replacement of stockade privacy fence at <br />rear yard. This COA was processed by John Oxian & Ed Talley in Mr. Duvall's <br />absence due to his accident. <br />2. DHPA Grant status <br />a. Mr. Duvall reported that he had come to agreement with Deputy Auditor, <br />John Lentz that funds which the HPC deposits with the County will be added to <br />the cash balance in the commissions appropriation thereby making them <br />available for our use. <br />b. National Register nominations: <br />Ms. Greiff is proceeding with work on the outstanding nominations. Mr. Duvall <br />reported meeting with her and staff from the State Historic Preservation <br />Office in which it was determined to not proceed with the nomination for the <br />South Bend Brewing Association property, but to submit the research and <br />documentation to the SHPO as a file for future use. The reason for this <br />decision is doubts as to the eligibility of the property due to lack of <br />integrity at the present time. Mr. Talley inquired as to whether the cistern <br />was being included in the North Pump Station nomination as he knows that <br />parking expansion may soon be proposed which could effect this structure. Mr. <br />Duvall responded with a definite maybe noting that he and Ms. Greiff had not <br />conclusively determined the boundary description and noting that the National <br />Register status would not effect such an impact unless federally funded. Mr. <br />Oxian noted that the landmark status includes the site. Mr. Duvall noted that <br />• the site boundary for this landmark was ambiguous as he has found the legal <br />description to be inaccurate. Mr. Talley noted that there was an original <br />condemnation in 1895 for the first pump station and artesian wells. Mr. Oxian <br />stated that his presentation to the Common Council had indicated inclusion of <br />the pump station, the cistern, and the reservoir. Mrs. DeRose indicated it <br />would be helpful to review the minutes of the common council meeting whence <br />this designation was established. <br />Mr. Duvall indicted that the National Register boundary would be either the <br />perimeter of the building itself or the driveway path which circumscribes the <br />area. The latter plan is the more probable choice and would include the <br />cistern. Mr. Oxian observed that the site established in the park for the <br />relocation of the Pharoh Powell house remains a landmark even though the house <br />has burned. <br />b. Economic Benefits Study <br />The Appraisal Group has completed approximately 800 of their work. Receipt of <br />the Draft Report has been delayed but is anticipated in the coming month. <br />V. New Business <br />Mrs. Petrass cited some of the complaints from Dr Lackman's letter regarding <br />the lack of notification and information about historic districts which often <br />come as a surprise to property owners. This sort of complaint to be too <br />common, especially after insufficient disclosure in the case of new purchases, <br />• and raised the question of how the commission can address this problem. Ms. <br />DeRose stated that she has always maintained the legal position that an owner <br />is on constructive notice that their property is within a historic District <br />(or other development or use description) and that it is the owner's <br />responsibility to inquire about and obtain required information. She noted <br />that this was a legal position but that the commission could possibly avert <br />
