Indiana had placed this structure on its Ten Most Endangered list for this <br />year. Mr. Fine added that roof stabilization was the focus of the present <br />program. <br />f. Inquiries <br />;1r. Duvall reported the following inquiries regarding the possibility of <br />establishing the following properties as Local Landmarks: <br />1. 1045 West Washington Street - Children's Dispensary <br />2. 30750 Inwood Rd. -.County Schoolhouse <br />The owner indicates this to be a one room schoolhouse constructed in 1925. It <br />was not noted in the IHSSI St. Joseph County Summary Report. It would have <br />been on the cusp of the 50 year threshold at the time of that survey. Ile has <br />had no opportunity- to for further research at this time. <br />3. 1122 West Colfax - Entzian house <br />Mr. Duvall indicated that this building has been altered and is not rated <br />sufficiently high to merit landmarking by the commission's criteria at this <br />time although restoration activity might merit future review. Mr. Oxian <br />indicated that the Summary report indicated the building top be a rated as a <br />C/10 while the survey card indicated C/9, neither meeting the S/11 threshold <br />for landmarking. ,1r. Duvall. observed that the Summary Report should probably <br />be considered correct. IIe discussed the procedure which has been established <br />in office for recording these discrepancies. Re -ratings will be brought to the <br />commission periodically in bundles. <br />,1r. Fine indicated that the new owner of the I -IPA House which has been moved <br />recently is interested in pursuing Local Landmark Designation. <br />Other Landmark concerns which have recently come to the attention of the HPC. <br />office are: <br />The desire of the Department of Economic Development to meet with us regarding <br />resources available should the City acquire the property at 701 East <br />Pennsylvania. The present plan is to include this structure in the new park <br />being developed in that vicinity. A meeting is to be established on this <br />topic. <br />From newspaper reporting, the State Board of Tax Commissioners appears to be <br />steering the South Bend School Corporation toward a demolition of Riley High <br />School as opposed to rehabilitation and expansion. <br />Mr. Oxian inquired about the log house on Rose Road which appears to have been <br />demolished without COA. Mr. Duvall will investigate further to determine the <br />situation. Mrs. DeRose mentioned that the possible remedy would be <br />reconstruction. She expressed that there was the possibility of getting an <br />order without capability of enforcement and cautioned for selective <br />application of judicial process. Mrs. Choitz indicated that some incentive or <br />assistance to preservation of such structures might be possible but is <br />unlikely in the local context. Mr. Duvall observed that the Bickel Cabin was <br />also in a precarious state of repair. Mrs. Choitz observed that this is the <br />sort of situation where easements may prove helpful. Air. Oxian reviewed the <br />status of the easement legislation which is believed to have been passed in <br />the last legislative session but which has not been reported adequately. Local <br />easement ordinances are already in place. <br />Bringing the discussion back to the Rose Road Cabin, Mrs Sporleder inquired if <br />the commission could place a lien on a property in such a case. Mrs. DeRose <br />said that she believed not. Mrs. Sporleder continued in this line of inquiry <br />about restrictions on the property after the demise of the Landmark structure. <br />Mr. Oxian indicated that until the designation was removed from the property, <br />a COA could continue to be required for any proposed development. Mrs DeRose <br />indicated that there would be due process issues which would come into play <br />and that the right not to be deprived of property without due process of law <br />is a very highly respected principle in the current Supreme Court. firs.
