STAFF REPORT: <br />Maintenance and Legal Update -- <br />"Problem Properties" <br />805 Arch Avenue -- Edgewater Place LHD <br />Background: Owners, Mr. and Mrs, Jeffrey Beers, removed a historic rear <br />entry canopy sometime before May, 1991 and were contacted by.staff. That <br />May the HPC directed the owners to replace the canopy appropriately as <br />approved by staff. The owners did not respond. In December, 1991 the owners <br />were contacted by staff to advise them of their legal obligation to follow <br />through with the reconstruction. <br />The owner sent a proposal in January, 1991 that was inappropriate. Staff <br />spoke to the owners, sending a suggested design for their approval. The <br />owners did not respond. On May 20, 1992 staff again wrote to the Beers and <br />asked for their cooperation; on May 23, 1992 the owners were given,a COA <br />pending approval of the final design. They have yet to respond. <br />On July 28, 1992 staff sent a final warning letter to the Beers stating <br />that the HPC did not want legal entanglements with owners of historically <br />designated properties but was prepared to enforce the Standards. They did <br />not respond. <br />Present Status: The matter was turned over to HPC legal counsel for action <br />on September 3, 1992. <br />Central High School & Oliver School <br />Background: The South Bend School Corporation was sent a letter on July 28, <br />1992 asking for compliance with HPC policy after site visits by staff and <br />Commissioner Herendeen revealed numerous problems with both structures. <br />Staff received a request from Acting Superintendent Ralph Komasinski on <br />August 6, 1992 requesting an additional twenty days to "research and <br />adequately respond" to HPC maintenance inquiries. <br />Present Status: The extra twenty day period will expire on September 23, <br />1992. <br />1204 Lincolnwav East -- Local Landmark <br />Background: Staff was informed of maintenance problems at this landmark <br />property in July, 1992. The owner, Mrs. Maria -,Williams, was sent a <br />notification of maintenance problems on July 23, 1992. Mrs. Williams called <br />staff on August 13, 1992 to say that "she would have the maintenance <br />problems attended to." She was asked to send a letter stating her <br />intentions. No reply was received; staff again sent the owner a letter on <br />September 3, 1992 asking for compliance. <br />Present Status: No reply received as of September 15, 1992. <br />1244 Lincolnwav East (the "Potpourri") -- Local Landmark <br />Background: Staff received a notice from Code Enforcement on September 3, <br />1 <br />
