Mr. Herendeen urged changing the <br />specifically to make it <br />o�advocate preservation of the <br />original structure. <br />Mrs. Schafer asked for direction in <br />composing apt wording. Mr. Oxian <br />suggested she confer with the staff. <br />Mr. Herendeen said all petition signers <br />should be city residents. Mr. Oxian <br />mentioned the probable great expense of <br />demolishing the building. He directed <br />Mrs. Schafer to make an appointment to <br />meet with the staff. <br />6. Standards and Maintenance <br />Mr. Herendeen reported that the East Wayne <br />Family & Children's Center was in very bad <br />condition. Mr. Pastor reported a phone call <br />from these owners informing him that work had <br />begun. The owners said they had gone to the <br />Building Department and been informed they <br />must comply with the provisions of the <br />American Disabilities Act. <br />Mr. Herendeen said the HPC would willingly <br />consider ADA requirements when evaluating any <br />rehabilitation proposals for this structure. <br />Nevertheless, something had to be done about <br />the site. Old Business <br />A. 1071'Riverside--Update <br />Mrs. DeRose reported further developments in the <br />case of the oval window installed in violation of COA <br />procedures by co-owners Ann Manion and Steve Murphy. <br />Approximately one month ago, she said, she'd sent Ms. <br />Manion a letter indicating the possibility of legal <br />action if this window were not replaced. Ms. Manion <br />had recently sent an answering letter. Ms. DeRose <br />submitted this letter to the board. <br />She said nothing in Ms. Manion's letter, in her <br />opinion, changed the status of the issues. She said <br />the letter indicated substantial profit from sale of <br />1071 Riverside; replacing the window would have a <br />negligible impact on that profit. In the letter, Ms. <br />Manion had offered to eliminate the front balustrade <br />and wanted to know if doing so would satisfy the HPC. <br />Ms. DeRose reported no expressed willingness in the <br />letter to change the window. The main problem, she <br />said, was that Ms. Manion had evidently sold the <br />house. If the deed had already been transferred, it <br />was too late to issue a writ of les pendens. <br />Mr. Herendeen said the HPC should find out whether <br />the deed transfer were final.
