Precedence for protective measures of cemeteries was first <br />established in La Porte, the only county in Indiana to form a <br />Pioneer Cemetery Commission. This was implemented by Acts 1980, <br />Public Law 8, section 135, now officially a part of the Indiana <br />Code as title 23, article 14, chapter 26, Care of Cemeteries by <br />Counties. The statute allows a County Cemetery Commission to be <br />formed for the restoration and maintenance of neglected <br />cemeteries developed before 1850 that "may be the burial grounds <br />for Indiana pioneer leaders as well as for veterans of.... <br />American war[s]." <br />Legal provisions are also provided under Acts 1980, chapter <br />27, which includes Care of Cemeteries by Townships. This chapter <br />applies to: cemeter[ies] that [are] without funds for <br />maintenance; [were] in existence on February 28, 1939 and; _[are] <br />either operated by a non-profit organization or [have] no <br />organization. The township trustees are responsible for <br />maintaining all such cemeteries. <br />However, in the case of a cemetery association applying for <br />assistance, a statement to the township trustee is required that <br />enumerates assets and liabilities. Under these acts, the <br />maintenance of cemeteries includes the following: a) <br />Straightening and fixing all monuments. b) Leveling and seeding <br />of the ground. c) Constructing fences where there are none, and <br />repairing others. d) Keeping weeds and brush mowed and cleaned <br />up. Resources for such care and maintenance of cemeteries may be <br />provided for by the township by levying a township cemetery tax, <br />in the absence of which part of the township fund may be used. <br />7.
