This
criterion has precedent elsewhere in the construction field.
The committee subsequently upheld the Commission's decision on
January 20, 1992, requiring removal of the elliptical window and
installation of a window more appropriate to the style of the
building. In other words, the Committee concurred with the
Historic Preservation Commission as a a whole and once again
denied -your Certificate of Appropriateness application dated
January 15, 1992.
The committee also informed you that pursuant to Chapter 21, Art.
6.5, Sec. 21-117.2.(5) b. of the Municipal Code of the City of
South Bend, "Upon [the] denial [of a Certificate of
Appropriateness], the applicant may appeal said denial to the
Common Council which shall make a final determination of the
application."
Thank you for your time in this matter.
Sincerely,
red Holycross
Director
Z'Vco (/ A,
James V.
