historic reservation c®mmissi <br />p ®n <br />of south bend and st. joseph county <br />ROOM 1123 COUNTY CITY BUILDING <br />south bend, indiana 46601 (219) 284-9798 <br />criterion chosen by the committee, i.e. a reasonable case for <br />hardship may be made by showing that the cost of compliance to <br />District standards --in this case replacing a window that was <br />changed without a Certificate of Appropriateness --would be twenty <br />percent (20%) more than the total cost of a project. This <br />criterion has precedent elsewhere in the construction field. <br />The committee subsequently upheld the Commission's decision on <br />January 20, 1992, requiring removal of the elliptical window and <br />installation of a window more appropriate to the style of the <br />building. In other words, the Committee concurred with the <br />Historic Preservation Commission as a a whole and once again <br />denied -your Certificate of Appropriateness application dated <br />January 15, 1992. <br />The committee also informed you that pursuant to Chapter 21, Art. <br />6.5, Sec. 21-117.2.(5) b. of the Municipal Code of the City of <br />South Bend, "Upon [the] denial [of a Certificate of <br />Appropriateness], the applicant may appeal said denial to the <br />Common Council which shall make a final determination of the <br />application." <br />Thank you for your time in this matter. <br />Sincerely, <br />�red Holycross <br />Director <br />Z'��Vco (/ A, <br />James V.
