In the case <br />of preservation guideline violations, the <br />court is likely to question the action on <br />the grounds that no health or safety <br />hazard exists (assuming such is the <br />case). It is not written in the enabling <br />legislation for Code Enforcement to act <br />on preservation codes. <br />Mr. Oxian suggested that Ms. DeRose <br />contact Code Enforcement to determine <br />what actions have been taken to rectify <br />the situation and what further actions <br />must be taken by Code Enforcement or the <br />Commission. <br />Ms. DeRose stated that, while Code has <br />the authority to enforce the building <br />code, and the building commissioner <br />enforces the preservation standards at <br />the request of the Commission, the <br />preservation standards simply say that <br />the owners must maintain the property. <br />Nothing states specifically what <br />constitutes a violation regarding <br />maintenance.
