Appendix C
• SWEENEY BUTLER & SIMERI
ATTORNEYS AT LAW
406 WEST WAYNE STREET
CHARLES A. SWEENEY, JR. SOUTH BEND, INDIANA 46601
JOSEPH V. SIMERI 219 299-9908
KEVIN J. BUTLER
May 15, 1984
Mr. John Oxian
1533 Lincolnway West
South Bend, Indiana 46628
Dear Mr. Oxian:
This will confirm our recent conversation concerning involvement
of St. Joseph County Historic Preservation Commission in the procedure
for tax assessment adjustment on property for which a facade easement
has been granted.
•It is my understanding that Southhold Restorations, Inc. has es-
tablished a procedure for the acceptance of facade easement grants and
that said procedure is comprehensive and satisfactory particularly with
respect to monitoring aspects. it is my opinion that for the St. Joseph
County Historic Preservation Commission to establish a similar procedure
would be redundant and, because of the effectiveness of the Southhold
procedures, also unnecessary. For the Commission to involve itself in
areas and programs which are effectively covered by other entities I
believe, is counterproductive because such involvement can only dilute
the effectiveness of existing Commission programs due to limited staff.
Please let me know if you wish any clarification or expansion of
my views on this matter.
Sincerely,
KJB:ljh
cc: Ms. Karen Kiemnec
0
Kevin J. Butler
