Appendix A <br />ST. JOSEPH COUNTY INDIANA <br />HISTORICr PRESERVATION COMMISSION <br />RESOLUTION <br />Statement of Purposes and Intent The St. Joseph County <br />Historic Preservation Commission ("Commission") in July*, 1979, <br />conducted an historical survey of the residence located at 601 <br />Lincolnway East in South Bend, Indiana ("601 LWE"). Said survey <br />resulted in an overall opinion rating of 12. A copy of said sur- <br />vey is attached to this Resolution. <br />In 1978, the South Bend Division -of -("Code <br />Code Enforcement <br />Enforcement") has noted code violations onother residences i I mme- <br />diately south of 601 LWE and owned by the s I am,e owners. Three of <br />said other residences have been demolished by Code Enforcement,, <br />and on November 16, 1981 the owners applied for a demolition permit <br />for 601 LWE. Since July of 1981, the Commission and its staff has <br />been actively involved with the South Bend Building Commissioner <br />("Building Commissioner"), Code Enforcement and the owners to <br />maintain and preserve 601 LWE. The Building Commissioner on April <br />29, 1982, determined that no demolition permit would be issued on <br />601 LWE until approved by I the Commission. On April 29, 1983, the <br />Commission received a copy of a letter from one of the owners to <br />Code Enforcement stating his intent to restore 601 LWE. On June <br />21, 1583, a hearing before Code Enforcement on 601 LWE resulted <br />in an order for completion of repairs on exterior code violations <br />by August 6, 1983, and on interior code violations.by August 30, <br />1983. No action has been taken by the owners to either restore <br />601 LWE or to comply with the repair order of Code Enforcement. <br />The Commission considers 601 LWE to be of significant histori- <br />cal value and deems it necessary to take whatever action is neces- <br />sary to maintain and preserve 601 LWE. <br />NOW, THEREFORE, BE IT RESOLVED by the St. Joseph County <br />historic Preservation Commission as follows: <br />1. The Commission and its staff shall make one final attempt <br />to have the owners make the code violation repairs and restore 601 <br />LWE. <br />2. If said attempt does not obtain satisfactory results by <br />February 24, 1984, then the Commission, through its Executive <br />Director, shall, pursuant to Section 21-117.2(e)(7) of the Muni- <br />cipal Code of the City of South Bend, Indiana, petition the <br />Building Commissioner to use the legal means available to him <br />to cause the maintenance and/or repair of 601 LWE. <br />
