the development, heritage, and culture of the <br />City of South Bend, St. Joseph County, the <br />�� <br />"�� State of Indiana, and the United States; <br />Its education value; <br />Its suitability for preservation; and <br />Its portrayal of the environment of a <br />group of people in an historical era. <br />The Committee shall draft the preservation guidelines and present <br />its findings and evaluation to the Historic Preservation Commission <br />for formal consideration of the nomination. <br />3, The Historic Preservation Commission or the neighborhood district <br />committee shall notify all property owners within the proposed <br />district of the application for nomination, the proposed zoning, <br />the preliminary draft of the guidelines and the voting procedure. <br />4. The Historic Preservation Commission and/or the neighborhood <br />districts committee shall secure the written consent of fifty (50%) <br />or more of the property owners within the proposed District by using <br />the petition form prescribed by the Area Plan Commission for re- <br />zoning. In the event that the owners of fifty percent /50%\ or more of <br />the property owners in the area proposed for such zoning refuse or <br />decline to give written consent to the proposed zoning, the Historic <br />40N� Preservation Commission may schedule a public hearing in the cause of <br />— the proposed zoning prior to the Commission's formal consideration of <br />the application for nomination. The Historic Preservation Commission <br />shall cause written notice of the date, time, and place of the hearing <br />to be given to every property owneror any person having a legal or <br />equitable interest in property located within the area being proposed <br />for zoning as an Historic Preservation District. The Historic Preser- <br />vation Commission shall also cause a legal notice to be publicized in <br />a newspaper of general circulation in St. Joseph County setting forth the� <br />nature of the hearing, the properties involved, and the date, time, and <br />place of the scheduled public hearing. <br />If the application for nomination and the proposed zoning as an <br />Historic Preservation District is approved by the Historic Preservation <br />Commission, then the proposed zoning of an Historic Preservation Dis- <br />trict shall be filed with the Clerk of the legislative body of the City <br />of South Band or St, Joseph County, as appropriate, in the usual manner by: <br />The Area Plan Commission; <br />A member of the legislative body; or <br />By petition of the owners of fifty percent <br />(50%) or more of the property involved in <br />the proposed zoning. <br />
