South Bend Redevelopment Commission
Regular Meeting - August 4, 1995
6. NEW BUSINESS (Cont.)
a. continued...
Nimtz Parkway R/O /W Vacation -
The proposal also requires the Commission
to vacate the unused right -of -way along the
northerly right -of -way line of Nimtz
Parkway. Currently, Nimtz Parkway is
anywhere from 60 ft to 100 ft. wide from
the centerline. Only 40 ft. of right -of -way
on either side of the centerline is needed.
This condition is acceptable to staff. Staff
has already been working on a plan for the
vacation of this right -of -way prior to the
receipt of this proposal. However, the
applicant should be reminded that the
authority to vacate right -of -way lies with
the Common Council and the Board of
Public Works, not the Redevelopment
Commission.
Filling -
The construction of Nimtz Parkway and
the Nimtz Parkway overpass over US 31
has left a large gully, nearly 20 feet deep
and almost 1000 feet long along the north
side of the Parkway. The applicant is
requiring the Commission to fill the gully
to bring the front part of this site to a
suitable grade. Previous estimates indicate
that approximately 12,000 cubic yards of
fill dirt is needed to fill the gully.
Again, this condition is acceptable to staff.
However, the applicant did not include a
deadline for this project. The Commission
could not complete this project until
sometime in 1996. The estimated cost of
the fill dirt, transportation of the dirt and
earthmoving is $55,000.
