South Bend Redevelopment Commission <br />Regular Meeting - August 4, 1995 <br />6. NEW BUSINESS (Cont.) <br />a. continued... <br />Nimtz Parkway R/O /W Vacation - <br />The proposal also requires the Commission <br />to vacate the unused right -of -way along the <br />northerly right -of -way line of Nimtz <br />Parkway. Currently, Nimtz Parkway is <br />anywhere from 60 ft to 100 ft. wide from <br />the centerline. Only 40 ft. of right -of -way <br />on either side of the centerline is needed. <br />This condition is acceptable to staff. Staff <br />has already been working on a plan for the <br />vacation of this right -of -way prior to the <br />receipt of this proposal. However, the <br />applicant should be reminded that the <br />authority to vacate right -of -way lies with <br />the Common Council and the Board of <br />Public Works, not the Redevelopment <br />Commission. <br />Filling - <br />The construction of Nimtz Parkway and <br />the Nimtz Parkway overpass over US 31 <br />has left a large gully, nearly 20 feet deep <br />and almost 1000 feet long along the north <br />side of the Parkway. The applicant is <br />requiring the Commission to fill the gully <br />to bring the front part of this site to a <br />suitable grade. Previous estimates indicate <br />that approximately 12,000 cubic yards of <br />fill dirt is needed to fill the gully. <br />Again, this condition is acceptable to staff. <br />However, the applicant did not include a <br />deadline for this project. The Commission <br />could not complete this project until <br />sometime in 1996. The estimated cost of <br />the fill dirt, transportation of the dirt and <br />earthmoving is $55,000. <br />
