NEW BUSINESS (Cont.) <br />a. continued... <br />inverse condemnation as our property rights <br />haven't been respected. <br />Mrs. Kolata read the remonstrance from <br />Azar, Inc. <br />Azar, Inc., successor in interest to <br />CharKing, Inc., hereby remonstrates and <br />objects to Resolution No. 1284, Resolution <br />of the City of South Bend Redevelopment <br />Commission, Amending the South Bend <br />Central Development Area Development <br />Plan. Azar's Inc. is the owner of the <br />easement which will be added to the South <br />Bend Central Development Area if <br />Resolution No. 1284 is passed. The basis <br />for this remonstrance is as follows: 1) it <br />will not be a public utility or benefit to <br />include the easement as part of the South <br />Bend Central Development Area; 2) the <br />easement is not necessary for the successful <br />completion of the Opelika apartment <br />complex; 3) the acquisition of the easement <br />enures to the private benefit of The <br />Alexander Company, Inc. and not to the <br />benefit of the public; 4) Amendment Number <br />1284 and the procedure followed by the City <br />of South Bend Redevelopment Commission <br />to enact Amendment No. 1284 are in <br />violation of Indiana law, including, but not <br />limited to the provisions of I. C. 36- 7 - -14. <br />Signed, George A.
