<br />bindinguponeachsubcontractororvendor.Thecontractorwilltakesuchactionwithrespect

<br />Theapplicantfurtheragreesthatitwillbeboundbytheaboveequalopportunityclausewith
<br />respecttoitsownemploymentpracticeswhenitparticipatesinfederallyassistedconstruction
<br />work:Provided,thatiftheapplicantsoparticipatingisaStateorlocalgovernment,the
<br />aboveequalopportunityclauseisnotapplicabletoanyagency,instrumentalityorsubdivision
<br />ofsuchgovernmentwhichdoesnotparticipate in workonorunderthecontract.
<br />Theapplicantagreesthatitwillassistandcooperateactivelywiththeadministeringagency
<br />andtheSecretaryofLaborinobtainingthecomplianceofcontractorsandsubcontractorswith
<br />theequalopportunityclauseandtherules,regulations,andrelevantordersoftheSecretaryof
<br />Labor,thatitwillfurnishtheadministeringagencyandtheSecretaryofLaborsuchinformation
<br />astheymayrequireforthesupervision ofsuchcompliance,andthatitwillotherwiseassist

<br />Theapplicantfurtheragreesthatitwillrefrainfromenteringintoanycontractorcontract
<br />modificationsubjecttoExecutiveOrder11246ofSeptember24,1965,withacontractor
<br />debarredfrom,orwhohasnotdemonstratedeligibilityfor,Governmentcontractsandfederally
<br />assistedconstructioncontractspursuanttotheExecutiveOrderandwillcarryoutsuch
<br />sanctionsandpenaltiesforviolationoftheequalopportunityclauseasmaybeimposed upon
<br />contractorsandsubcontractorsbytheadministeringagencyortheSecretaryofLaborpursuant
<br />toPartII,SubpartDoftheExecutiveOrder.Inaddition,theapplicantagreesthatifitfailsor
<br />refusestocomplywiththeseundertakings,theadministeringagencymaytakeanyorallofthe
