<br />PROVISIONSDIVERSITYUTILIZATION
<br />ItisthepolicyoftheCityofSouthBendtoprovideequalemploymentandbusinessopportunityforall
<br />persons,partnerships,companies,andcorporationsinaccordancewiththerules,regulationsandguidelinesof
<br />theapplicablefederal,stateandlocallaws.Thispolicyofequalemploymentandbusinessopportunityshall
<br />applytoeverycontractororsubcontractorbiddingorholdingapubliccontractwiththeCityofSouthBend.
<br />Infurtheranceofthispolicy,thefollowing EqualOpportunity Clausesareherebymadeapartofevery
<br />constructioncontractenteredintobytheCityofSouthBendandallsubcontractorsenteredintopursuant
<br />toanysuchcontractandthebidderherebycertifiesthatit/he/shewillabidebytheseprovisions.
<br />Thecontractorwillnotdiscriminateagainstanyapplicantoremployeebecauseofrace,color,
<br />religion,sex,nationalorigin,orhandicap.Thecontractorwilltake affirmativeactiontoensure
<br />thatallapplicantsoremployeesaretreatedfairlyandequitably.Suchactionshallinclude
<br />butnotbelimitedtothefollowing:hiring,up-grading,demotionortransfer,recruitment,
<br />advertising,lay-offsortermination,ratesofpayorotherformsofcompensationandselectionfor
<br />trainingincludingapprenticeshipprograms.
<br />Thecontractorshallagreetopostinconspicuousplacesavailabletoemployeesandapplicants,
<br />noticestobeprovidedsettingforththeprovisionsoftheNon-DiscriminationClause.
<br />Thecontractorwill,inallsolicitationsoradvertisementsforemployeesplacedbyoronbehalfof
<br />thecontractor,statethatallqualifiedapplicantswillreceiveconsiderationforemployment
<br />withoutregardtorace,color,religion,sex,ornationalorigin.
<br />Thecontractorwillsendtoeachlaborunionorrepresentativeofworkerswithwhichit/he/she
<br />hasabargainingagreementorothercontractorunderstanding,anoticetobeprovided,
<br />advisingthelaborunionorworker'srepresentativesofthecontractor'scommitmentunderthis
<br />section,andshallpostcopiesofthenoticesinconspicuousplacesavailabletoapplicants
<br />andemployees.
<br />ThecontractorwillcomplywithallprovisionsofExecutiveOrder 11246(as amendedby11375)
<br />andoftherules,regulationsandrelevantordersoftheDepartmentofLabor.
<br />SubpartB--Contractors'Agreements
<br />Sec.202.ExceptincontractsexemptedinaccordancewithSection204ofthisOrder,allGovernment
<br />contractingagenciesshallincludeineveryGovernmentcontracthereinafterenteredintothefollowing
<br />provisions:
<br />"Duringtheperformanceofthiscontract,thecontractoragreesasfollows:"
<br />"(1)Thecontractorwillnotdiscriminateagainstanyemployee orapplicantforemployment
<br />becauseofrace,color,religion,sex,ornationalorigin.Thecontractorwilltakeaffirmativeaction
<br />toensurethatapplicantsareemployed,andthatemployeesaretreatedequallyduring
<br />employment,withoutregardtotheirrace,color,religion,sexornationalorigin.Suchactionwill
<br />include,butnotbelimitedtothefollowing:employment,upgrading,demotion,ortransfer;
<br />recruitmentorrecruitmentadvertising;layoffortermination;ratesofpayorotherformsof
<br />compensation;andselectionfortraining,includingapprenticeship. Thecontractoragreestopost
<br />inconspicuousplaces,availabletoemployeesandapplicantsforemployment,noticestobe
<br />providedbythecontractingofficersettingforththeprovisionsofthisnondiscriminationclause."
<br />"(2)The contractorwill,inallsolicitationsoradvertisements foremployeesplaced byoronbehalf
<br />ofthecontractor,statethatallqualifiedapplicantswillreceiveconsiderationforemployment
<br />withoutregardtorace,color,religion,sexornationalorigin."
