Ms. Schwartz <br />.ained that this lawsuit arises as a result <br />:he Commission's ownership of the land on <br />:h the lst Source Center is located. The <br />Liss.ion owns that land and leases it to lst <br />-ce Bank and JVJ Joint Ventures. The suit <br />e between Slutsky Peltz and Slatile <br />:erning a contract that was entered into <br />lst Source Bank and Slutsky Peltz. <br />.sky Peltz then subcontracted some work to <br />Ile back in 1980. A dispute arose between <br />,e two contractors which resulted in a <br />Lanics lien being filed against lst Source <br />.er. The mechanics lien was attempted to <br />oreclosed, and the Department of <br />,velopment was named in the lawsuit closing <br />use they are the owner of the property. <br />of these matters are about to be resolved <br />the lawsuit is about to be dismissed <br />.ingent on the settlement agreement among <br />the parties. Ms. Schwartz stated she <br />ewed the proposed settlement agreement and <br />s that it adequately represents the <br />Fission and protects their interest as a <br />ertv owner. <br />Upon a motion made by Mr. Piasecki, seconded <br />by As. Auburn and unanimously carried, the <br />Co ssion authorized the President and <br />Secretary to sign the necessary Release of <br />Reciprocal Settlement Agreement in relation to <br />lst Source Center. <br />6.
