I structions Regarding <br />A firmative Action in Contracting <br />P ge 2 <br />C`_] <br />wi <br />(i) Minority business enterprise means any minority -owned <br />business which has been certified under the requirements <br />of the City affirmative action ordinance. <br />(j) Subcontractor means any person, partnership, corporation, <br />association or joint venture which supplies any of the <br />work, labor, services, supplies, equipment, materials or <br />any combination of the foregoing under a contract with the <br />contractor on a City contract. <br />(k) Women business enter rise means any women -owned business <br />which has been certified under the requirem6nts of the <br />City affirmative action ordinance. <br />II. PROCEDURES <br />A. QUALIFICATION. Each bidder under a City contract must be <br />,lified in order to have its bid considered by a City board, <br />artment, or agency. To be qualified a bidder must submit a <br />pleted Application for Qualification before bid submission or <br />h its bid. The bidder must attach the following written <br />mitments to the Application for Qualification: <br />1. Nondiscrimination commitment, which states that the <br />Contractor and each of its subcontractors agree not to <br />discriminate against any employee or applicant for employment <br />in the performance of the contract with respect to hire, <br />tenure, terms, conditions or privileges of employment, or any <br />mat er directly or indirectly related to employment, because <br />of race, religion, color, sex, handicap, national origin or <br />ancestry. Breach of this provision may be regarded as a <br />material breach of the contract. <br />2. Affirmative action affidavit, which states that the <br />Contractor has adopted and will maintain in full force and <br />eff ct for one year from the date of the affidavit, an <br />affirmative action plan for the recruitment, hiring and <br />employment of minorities and women.
