Friday..... Oct. 9th, 1903-. The Board met in regular session, all members being present. Contracts were awarded as follows: M.S.Rogers on Poland st reetq McSheery and Baer on,Ewing avenue and Fox street. President. SPECIAL SESSION, 7:15 P.P.M- The Board met ih special session, having under consideration. Co the hearing on the roll of awards and assessments in the condemnation for the opening o der Condemnation Resolution +129 which said roll was adopted on the 9th. day of September919039 The Oliver Chilled Plow Works, by Jos. D., Oliver, appeared before the Board and submitted ti following communication relative to their awards of damages, which follows- viz: To the Board of Public Works, _ South Bend, Oct* 3rd, 1903. South Bend, Ind.. Dear Sirs; We have received your notice of our awards of damages in the Colfax avenue opening. The sum alloted us by no means represents the adan►age actually occasioned by the taking; of the real estate and the damage to the Hill Phoenix Mill. The portion of this will which would remain would not give sufficient floor space for milling purposes, so we will, as conditioned below, remove the mill building from the space appropriated. If we were to look upon this matter as a business proposition we would be prompted to appeal from your decision, but in view of the public interest in the Colfax avenue bridge, we will abide by your decision provided that you can assure us that the driveway from Michigan stre at Colfax avenue to what is known as the City Roller Mills, on the north side of said avenue, will not be molested. Your Board is probably aware , and. the City records and has been recognized undoub- tedly show, that the driveway was authorized over fifty years ago, If the Board will by the city in planning the garde for that portion of the avenue. assure us that the grade of the street relative to the proposed bridge construction will also recognize this driveway, we will abide by theawards of damages without appeal. And the Board being fully advised in the matter and knowing that the plan, grade and pro- file on said avenue has always been maintained with a view to the us.e of said driveway, Now therefore be it resolved by the Board of Public Works, that the proposition of the Oliver Chilled Plow Works be accepted and the Board hereby instructs the Engineer to plan improvement of said avenue with view tthe continued osaid driveway to the use confirm and legalize of said driveway. No further remonstrances were filed and no remonstrants appeared. The Board finds that the proper-iies described in the assessment roll are respectively damaged and benefited in the amounts shown on said roll, and that said roll filed on and adopted on 9th. day of September, 19030 should be and the same is hereby in all thing ratified, confirmed and approved.
