Friday..... Oct. 9th, 1903-. <br />The Board met in regular session, all members being present. <br />Contracts were awarded as follows: M.S.Rogers on Poland st reetq McSheery and Baer <br />on,Ewing avenue and Fox street. <br />President. <br />SPECIAL SESSION, 7:15 P.P.M- <br />The Board met ih special session, having under consideration. <br />Co the <br />hearing <br />on the <br />roll of awards and assessments in the condemnation for the opening o <br />der <br />Condemnation Resolution +129 which said roll was adopted on the 9th. day of September919039 <br />The Oliver Chilled Plow Works, by Jos. D., Oliver, appeared before the Board and submitted ti <br />following communication relative to their awards of damages, which follows- viz: <br />To the Board of Public Works, <br />_ South Bend, Oct* 3rd, 1903. <br />South Bend, Ind.. <br />Dear Sirs; <br />We have received your notice of our awards of damages in the Colfax avenue <br />opening. The sum alloted us by no means represents the adanâșage actually occasioned by the <br />taking; of the real estate and the damage to the Hill Phoenix Mill. The portion of this <br />will which would remain would not give sufficient floor space for milling purposes, so we <br />will, as conditioned below, remove the mill building from the space appropriated. If we <br />were to look upon this matter as a business proposition we would be prompted to appeal <br />from your decision, but in view of the public interest in the Colfax avenue bridge, we will <br />abide by your decision provided that you can assure us that the driveway from Michigan stre <br />at Colfax avenue to what is known as the City Roller Mills, on the north side of said <br />avenue, will not be molested. Your Board is probably aware , and. the City records and has been recognized undoub- <br />tedly show, that the driveway was authorized over fifty years ago, If the Board will <br />by the city in planning the garde for that portion of the avenue. <br />assure us that the grade of the street relative to the proposed bridge construction will <br />also recognize this driveway, we will abide by theawards of damages without appeal. <br />Yours respectfully, <br />OLIVER CHILLED PLOW WORKS. <br />Jos. Oliver, Treas. <br />And the Board being fully advised in the matter and knowing that the plan, grade and pro- <br />file on said avenue has always been maintained with a view to the us.e of said driveway, <br />Now therefore be it resolved by the Board of Public Works, that the proposition of the <br />Oliver Chilled Plow Works be accepted and the Board hereby instructs the Engineer to plan <br />improvement of said avenue <br />with <br />view <br />tthe <br />continued <br />osaid <br />driveway <br />to the use <br />confirm and legalize <br />of said driveway. <br />No further remonstrances were filed and no remonstrants appeared. The Board <br />finds that the proper-iies described in the assessment roll are respectively damaged and <br />benefited in the amounts shown on said roll, and that said roll filed on and adopted on <br />9th. day of September, 19030 should be and the same is hereby in all thing ratified, <br />confirmed and approved. <br />President. <br />A-r_ <br />aQ - , <br />
