South Bend Commission <br />Rescheduled �edevelopment <br />Regular Meeting - June 12, 1981 <br />5. PUBLIC GEARING (continued) <br />Mr. McMahon presented the Commission with the following <br />items and asked that they be entered into the record: <br />Original Notice of Public Hearing; Affidavit of Proof of <br />Publica ion from the South Bend Tribune and Tri- County <br />News; Affidavit that notice was delivered to Area Plan <br />Commission, Board of Public Works, Board of Zoning Appeals, <br />Building Department, Park Department, and that notice was <br />posted on the bulletin board of the Board of Public Works; <br />Area Plan Commission Resolution No. 57; Common Council <br />Resolut on No. 885 -81; and a copy of Redevelopment Commis- <br />sion Re olution No. 636 and a copy of the Monroe - Sample <br />Develop ent Plan. <br />Mr. McM hon informed the Commission that as of 10:00 a.m. <br />this mo ning no written remonstrances with respect to our <br />action ere received. <br />Mr. Nim z recognized and received the various legal notices, <br />publica ions, affidavits, and other documents and ordered <br />them en ered into the record. <br />Mr. McMahon explained this is the second Resolution with <br />respect to acquisition of properties in the Monroe - Sample <br />Development Area. Our proposed action today does not re- <br />flect an type of change in the original plan we presented <br />in February and March to the Commission with respect to <br />our intentions in the-Monroe-Sample area. It simply is a <br />formal approval to allow the Commission to consider acqui- <br />sition of properties in the second phase. <br />Mr. Nim z opened the meeting for any comments or discussion <br />by the p blic. <br />Mr. David Anderson inquired whether there has been any <br />legal action filed by any of the people you may have <br />property bought by the Commission and how homes located <br />in an area designated for future industrial use are being <br />appraise - at residential or industrial rates. <br />Mr. McMa <br />nor has <br />Properti <br />they are <br />properti <br />independ <br />that the <br />purchase <br />on replied that no legal action has been filed <br />any condemnation action been filed at this point. <br />s are being bought based on their appraisals, <br />not appraised as industrial.
