PROGRESS REPORTS <br />a. <br />tinued... <br />Mrs. Kolata: The only public hearing <br />actually called for in the ordinance <br />is at the City Council. There will <br />be legal notices of the hearing and <br />it would be at the time -of the recon- <br />firming resolution. The whole process <br />would probably take 6 to 8 weeks for <br />each decision, by the time it makes <br />the rounds. I believe we have 30 days <br />to investigate and report, and I <br />believe Area Plan also has 30 days to <br />see if each abatement request is in <br />conformity with the master plan. <br />Mr. Kagel: I have a question. If <br />rejected by the Area Plan Commission, <br />is there redress or recourse? <br />Mr. Ellison: Well that is not spelled <br />out in detail but the local ordinance <br />models the state redevelopment statute <br />in terms of procedures that we go <br />through for declaratory process. If <br />the Commission passed a declaratory <br />resolution and the Area Plan Commission <br />had objections, the Commission would take <br />those into account as the resolution came <br />back for the confirming declaratory process. <br />Presumably the Commission, or the <br />Council in this instance, would make <br />some judgement. I really suspect from a <br />practical matter that the Area Plan's <br />concurrence would likely be fairly <br />standard. If there are problems, they <br />would likely occur on the front end where <br />the Redevelopment Commission is asked to do <br />a study and to provide evidence to show that <br />the statutory tests are met. If, for <br />instance, we receive a request or <br />petition for property that clearly <br />does not meet any of those tests, that is <br />that the public action is not necessary <br />to cause some development to happen <br />if the area is not right, etc. We <br />would presumably put that in the report, <br />and recommend that an abatement not be <br />be granted. <br />-31- <br />
