Robinson made a motion to obtain outside legal <br />ounsel from the Circuit Court Judge to advise the <br />ommission as to whether there has been a conflict <br />f interest, or as to whether there will be a <br />ontinuing conflict of interest with the Michiana <br />itle Corporation. <br />s. Auburn: I would like to clarify my statement <br />o Mr. Robinson. I asked for an outside legal <br />irm to give us, as Commissioners, legal guidance <br />n how to proceed in handling this matter and I <br />hink there is a big difference. <br />[r. Robinson therefore made a motion that the <br />edevelopment Commission request the Circuit <br />ourt Judge to appoint an attorney as an outside <br />egal counsel to advise the Commission as to <br />hether there will be a continuing conflict of <br />nterest if we employ Mr. Kevin J. Butler and <br />ontinue to use Wchiana Title Corporation without <br />ny restrictions as to who the Judge appoints..... <br />[r. Cira: Mr. Nimtz, why must we continue to have <br />his problem, why don't we just drop this? <br />Ls. Auburn: The problem stems from the fact that <br />hen you go through audits, such as the State <br />oard of Accounts, HUD etc. there is a concern that <br />he monies that have been paid will be disallowed, and <br />n two years we will be back here talking about the <br />ame issue again. Only then it will be under more <br />erious types of conditions because we are going <br />o have to pay back a lot of funds. I think that <br />s Commissioners it behooves us to not ask Kevin <br />o fulfill that role at this point in time, rather <br />han seeking outside general counsel to simply <br />Avise us on how to proceed with this matter. <br />-10- <br />
