South Bond Redevelopment Commission <br />Regular Meeting - January 2, 1980 <br />4. COMMUNICATIONS (continued) <br />Mr. Nimtz: I feel that is what <br />Mr. Robinson wants to do here ... it is a <br />matter of what is the motion. <br />Ms. Auburn: I still feel there are problems <br />because my memo says this may be politically <br />motivated ..... I have concerns about leaving <br />it within the local community. If we leave <br />it open for the Circuit Court Judge to decide <br />on legal counsel, and go anywhere he wants to <br />obtain this counsel, I will, with reservations, <br />support your motion. <br />\Ir. Robinson made a motion that the Commission <br />request the Circuit Court Judge of St. Joseph <br />County to appoint independent legal counsel for <br />the Commission to investigate and advise the <br />Commission as to whether there has been a conflict <br />:)f interest, and whether there will continue to <br />3e a conflict of interest if we retain Kevin Butler <br />as our legal counsel, seconded by Mr. Donaldson, <br />and the motion was unanimously carried. (The <br />Chair also voted "aye ") <br />4r. Hill: I have a question as to whether the <br />Circuit Court Judge would be limited to the <br />appointing of counsel that would be from this <br />community. <br />dr. Nimtz: The motion leaves it open to whomever <br />the Judge wants to appoint. He may have trouble <br />Jbtaining any one to do this. <br />r. Donaldson: If the Circuit Court Judge of <br />t. Jospeh County has trouble in obtaining legal <br />ounsel would he then seek counsel from anywhere <br />e wishes to do so? <br />r. Nimtz: That is correct. The Chair will <br />ait upon the Circuit Court and explain this <br />ituation to him and request him to appoint <br />ndependent counsel. Mr. Butler, do we need a <br />Dtion to have counsel paid for? <br />. Butler: No. <br />Ellison: I don't believe the Department of <br />velopment will have any trouble paying for the <br />ices of legal counsel. <br />- 11 - <br />
