Union membership and/or as members ofbargaining units <br />covered by Collective Bargaining Agreements. Such Employees <br />may request that a Union representative be available or present <br />prior to any action taken by an Employer, if any, at any stage of <br />the policy and its administration. If an .Employee is aggrieved by <br />any action taken under this rCRC Drug and alcohol Policy and <br />his/leer complaint cannot be resolved, the complaint may, if the <br />Employee or Union requests, be referred as a grievance under the <br />grievance and arbitration provisions of the Employee <br />Collective Bargaining Agreement. In the event the matter is <br />referred to arbitration, the arbitrator shall be bound substantively <br />by the provisions of this BCRC Drug and Alcohol Policy.. <br />ILLINOIS —"DRUG FREE WORKPLACE ,ACT" — <br />30 ILCS 580 <br />When working on public projects in the State of Illinois, <br />Employers must comply with the Illinois Drug Free Workplace <br />.A:ct.'This Act requires Employers to certify that it provides a drug <br />free workplace by complying with certain steps. First, the <br />Employer must publish a statement to its Employees notifying <br />them that as a condition of employment, drug possession, use, etc. <br />is prohibited at work and specify the actions taken if this is <br />violated. Second, Employers must provide each Employee <br />worl ing in Illinois a copy of this published statement. T ird, <br />Illinois requires Employers to provide a drug free awareness <br />program to inform Employees about drug abuse, the Employer's <br />drug free policy, the availability of drug assistance programs, and <br />penalties for drug violations. If the Employer receives notice of an <br />Employee's criminal drug conviction, the Employer roust notify <br />the Illinois agency in the contract within ten (10) days. Finally, if <br />an Employee violates the drug free policy, an Employer has thirty <br />(30) days to take action against the Employee, up to and including <br />termination or requires the Employee to satisfactorily participate <br />in an approved drug abuse assistance program. <br />41 <br />
