test result by telephone to investigate whether a legal <br />prescription (or other legitimate medical reason) has <br />caused the specimen to test positive. If the <br />individual does not consult with the MRO and provide! <br />the necessary information within forty-eight (48) hours <br />of being contacted by the MR O (delays in responding <br />caused by verifiable erner WM'icy or medical issues will <br />be given consideration for exception) or he/she has no <br />legal prescription, the MR O will take appropriate steps, <br />to report a verified positive to the BCRC Program <br />Administrator, who will then invalidate the Employee's <br />certification card. AD, persons who have tested positive <br />must have their return to work cleared by the EAP <br />5. All non -negative (positive) specimens will be retained <br />frozen in a locked facifity at the testing laboratory for <br />one (1) year Me retainecl specinlens will be available <br />should the results of the initial test be disputed or should <br />arbitration, or litigation arise out of the actions taken <br />because of the test results. <br />21 <br />
