REGULAR MEETING JANUARY 28, 2020 21 <br />I <br />public sanitary sewer system of the City, to provide sanitary sewer service to the below <br />referenced property, the applicant waives and releases any and all rights to remonstrate against or <br />oppose any pending or future annexations of the properties by the City of South Bend: <br />A. Tom Jones, 53180 Poppy Rd, South Bend, IN 46628 <br />1. 53180 Poppy Rd — Sewer (Key No.021-1152-5897) <br />Upon a motion by Ms. Maradik, seconded by Ms. Dorau and carried, the Consent to Annexation <br />and Waiver of Right to Remonstrate was approved as submitted. <br />RATIFY APPROVAL AND/OR RELEASE CONTRACTOR EXCAVATION AND <br />OCCUPANCY BONDS <br />The Division of Engineering Permit Department recommended that the following bonds be <br />ratified pursuant to Resolution 100-2000 as follows: <br />Business <br />Bond Type <br />Approved/ <br />Released <br />Effective Date <br />Steve Carlisle <br />Occupancy <br />Approved <br />January 15, 2020 <br />Steve Carlisle <br />Contractor <br />Approved <br />January 15, 2020 <br />Ms. Maradik made a motion that the bond's approval as outlined above be ratified. Ms. Dorau seconded the motion, which carried. <br />PRIVILEGE OF THE FLOOR <br />Mr. Huey Schoby thanked the city for opening up Jefferson Blvd. for the Martin Luther King Jr. <br />walk. He requested an update on his request that Martin Luther King Jr. Blvd. be moved from <br />U.S. 31, a State highway, to Michigan St. in front of the Morris Performing Arts Center. Mr. <br />Gilot noted he had responded previously with a letter to Mr. Schoby and questioned if he <br />received that. Mr. Schoby stated he had but the response was not satisfactory to the community. <br />He noted the previous Mayor stood in front of the public and announced the street naming, but <br />he was not representing the 900 community members requesting the change. He suggested the <br />members of the group doing the study were not representative of the community. Mr. Schoby <br />presented Mr. Gilot with a memo from him to the City and the Mayor outlining his request for <br />the change. Mr. Gilot noted it was dated prior to his letter responding to Mr. Schoby, but he <br />would take it under advisement. Mr. Gilot explained the Board is not authorized to make a <br />decision on his request. He stated we love and respect you, but Mayor Pete had a large group of <br />community members do a one (1) year study on the renaming and the outcome of that study must <br />be respected. He noted the Board will take Mr. Schoby's request under advisement with the new <br />Mayor. <br />ADJOURNMENT <br />There being no further business to come before the Board, upon a motion made by Mr. Gilot, <br />seconded by Ms. Maradik and carried, the meeting adjourned at 10:00 a.m. <br />BOARD OF PUBLIC WORKS <br />
