SOUTH BEND REDEVELOPMENT COMMISSION MEETING MINUTES <br />NOVEMBER 11, 1977 <br />PAGE THREE <br />4. <br />5. <br />COMMUNICATIONS CONT'D <br />Mr. Brownell indicated that he felt there was more of a problem to this <br />than what appeared on the surface. Mr. Pat McMahon of the City Engineer's <br />office was asked to look into this matter and as of this date we have not <br />heard from him. Mr. Wiggins added for the record that he personally <br />inspected the wall prior to the public hearing, as it was discussed at the <br />public hearing and it appeared to Mr. Wiggins that the lower wall appeared <br />to be a party wall with the area above that apprearing to be free standing <br />or separating wall. During that hearing one of the members of the joint <br />venture indicated that he had the abstracts of the building indicating the <br />building that was adjoining the Odd Fellows Building was there before the <br />Odd Fellows Building and that it came up to the first floor. So there is <br />a two-fold problem here, for up to the first floor a party wall might exist <br />and above it a free standing wall that we are probably obligated to take down. <br />Mr. Butler indicated that a party wall situation was a joint responsibility. <br />Mr. Wiggins indicated then that we needed to determine exactly what is <br />in ooved, the limit of Redevelopment's responsibility, the joint responsibility, <br />ani we should know these things before anything is done, Mr. Nimtz indicated <br />that he felt a need to reply to Mr. Anderson's letter, an indication that <br />tha City Engineer is involved in the investigation and ask Mr. Anderson what <br />th it legal documentation reveals as to the existance of a party wall or not. <br />BUSINESS <br />Thore was no old business. <br />6. NEW BUSINESS <br />a. Approval of the Commission is requested for the authorization of the <br />execution of Resolutions 543, 5441 545; 5465 547 for the disposition <br />of land and the execution of quit claim deed (s) for the transfer of <br />title in connection with land to be disposed of in Project Indiana R -57, <br />LaSalle Park. <br />Mr Brammer indicated that this was.land left over and according to the officials <br />at HUD they would rather us keep the ownership of the land and sell it like <br />we usually do. Mr. Brammer indicated further that the land was 50 percent <br />buildable, but that the rest would make suitable garden area adjacent to a <br />persons property. The appraisals were in the area of $.05 and $.02 per square <br />foot. The low bidder was the Bank of American together with <br />itinental Illinois National Bank and Trust Company of Chicago and Merrill <br />ich, Pierce, Fenner and Smith Incorporated in the amount of $2,195,000 at <br />interest rate of 3.42% and a premium of $145.00.
