SOUTH BEND REDEVELOPMENT COMMISSION MEETING MINUTES
NOVEMBER 11, 1977
PAGE THREE
4.
5.
COMMUNICATIONS CONT'D
Mr. Brownell indicated that he felt there was more of a problem to this
than what appeared on the surface. Mr. Pat McMahon of the City Engineer's
office was asked to look into this matter and as of this date we have not
heard from him. Mr. Wiggins added for the record that he personally
inspected the wall prior to the public hearing, as it was discussed at the
public hearing and it appeared to Mr. Wiggins that the lower wall appeared
to be a party wall with the area above that apprearing to be free standing
or separating wall. During that hearing one of the members of the joint
venture indicated that he had the abstracts of the building indicating the
building that was adjoining the Odd Fellows Building was there before the
Odd Fellows Building and that it came up to the first floor. So there is
a two-fold problem here, for up to the first floor a party wall might exist
and above it a free standing wall that we are probably obligated to take down.
Mr. Butler indicated that a party wall situation was a joint responsibility.
Mr. Wiggins indicated then that we needed to determine exactly what is
in ooved, the limit of Redevelopment's responsibility, the joint responsibility,
ani we should know these things before anything is done, Mr. Nimtz indicated
that he felt a need to reply to Mr. Anderson's letter, an indication that
tha City Engineer is involved in the investigation and ask Mr. Anderson what
th it legal documentation reveals as to the existance of a party wall or not.
BUSINESS
Thore was no old business.
6. NEW BUSINESS
a. Approval of the Commission is requested for the authorization of the
execution of Resolutions 543, 5441 545; 5465 547 for the disposition
of land and the execution of quit claim deed (s) for the transfer of
title in connection with land to be disposed of in Project Indiana R -57,
LaSalle Park.
Mr Brammer indicated that this was.land left over and according to the officials
at HUD they would rather us keep the ownership of the land and sell it like
we usually do. Mr. Brammer indicated further that the land was 50 percent
buildable, but that the rest would make suitable garden area adjacent to a
persons property. The appraisals were in the area of $.05 and $.02 per square
foot. Mr. Wiggins moved that we adopt the resolutions seconded by Mr. Donaldson.
Mr Nimtz indicated that the president and secretary would be authorized to
e(yite agreements and deeds concerning these parcels of real estate, all were
b.l Report on Bids of Indiana R -66 Project Notes
Mr
Co
an
to
Brownell indicated bids were taken on November 15 at 1:00 p.m. in the
)unt of $2,195,000.
