7. PROGR(SS REPORTS (Continued): <br />Mr. Brownell further reported on the City Council meeting of February 28, CITY <br />concerning a zoning ordinance. The Area Plan people apparently had made a COUNCIL <br />mistake in the zoning ordinance and they had the (building) height in MEETING <br />Block 6 limited to two and one -half (2 1/2) stories. Of course, the 2 -28 <br />elder y housing unit is to be twelve (12) stories, so they were trying <br />to ge that corrected. Some questions were asked of Mr. Brownell about <br />that, and they passed the amended ordinance also. <br />The final <br />progress report <br />given by Mr. Brownell was the <br />matter with <br />SETTLEMENT <br />Standard <br />Oil. When we built <br />Lincoln Way East and Monroe <br />Street some <br />OF AMOCO <br />years <br />ago (and closed the <br />old Lincoln Way), they had an <br />encroachment <br />ENCROACH - <br />on their <br />gasoline station <br />property owned by Standard Oil <br />Company, which <br />MENT <br />has now <br />changed its name <br />to American Oil Company. <br />Mr. Brownell: I am not sure whether they don't have another name now -- <br />Amoco -- I have to get the name squared away with them. I went to <br />Detroit last Wednesday night and met with them on Thursday (two attorneys). <br />We reviewed this matter and they gave me their prints and I gave them <br />ours. I came home and met with Clyde Williams. I have prints from <br />Clyde Williams this morning, showing the piece of land that we en- <br />croached on, that belongs to the American Oil Company apparently. It <br />is in the street now, and it's a very narrow, thin strip. (Mr. Brownell <br />indicated the size and shape of the subject encroachment on a map.) <br />It is 782 square feet -- a sliver, then there is a larger piece of land <br />which is 2721 square feet which was in the street, which is not in the <br />streel any longer. This larger piece of land has been sodded and looks <br />just like their property. They have never petitioned to vacate it, and <br />we hole that we can get that petition drafted and get them to sign it, <br />and s gn our petition to dedicate this parcel into the street, so <br />that it will be a "swap" the land we are using now for the land we <br />are n t using. We hope that will settle it, if that is agreeable to <br />the C mmission. It seems to me that it's the sensible and reasonable <br />way t settle it if you are agreeable. <br />The Chair asked for a motion that Mr. Brownell and Legal Counsel be <br />autho ized to proceed to settle this matter by the exchange of real <br />estat . <br />Motior was made accordingly by Mr. Wiggins, seconded by Mr. Cira, and <br />carri d. <br />When ihe question was put to Mr. Butler as to the adequacy of this <br />motion, he indicated that it would suffice. <br />The C air asked if there were further comments or questions by the <br />Membe s of the Commission. <br />Mr. Rc <br />to out <br />inson: Mr. Chairman, I have been giving just a quick thought <br />problem, and differences of opinion, while sitting at this <br />124 <br />
