6. OLDI BUSINESS. <br />a. Easement grant between Indiana & Michigan Electric Company and EASEMENT <br />the parties of interest in the Block 6 development: The request GRANT -I & M <br />for our participation in the easement grant by the St. Joseph BLOCK 6 <br />River Bend Development Corporation was tabled in the November 19, <br />1976 meeting and referred to legal counsel. We have not yet <br />deeded this property over to them. <br />Mr. Butler stated that he has had preliminary discussions with Mr. <br />Lloyd Taylor on both (a) and (b) under Old Business, (b) being <br />their claim and request to the department for participation in <br />costs to them for correcting what they claim is a condition that <br />resulted from our involvement in the site improvements in that area. <br />I would imagine said Mr. Butler that by the first or second meeting <br />in January, 1977, we should have either resolved these matters or <br />know that the River Bend-Development Corporation will be filing a <br />formal claim against us. <br />b. lRequest for Department of Redevelopment to make payment of $5,000. STORM <br />to St. Joseph River Bend Development Corporation for the additional SEWER - BU <br />work•to- be-done on the storm sewer in Block 6:Following the above 6 - ST. JOB <br />explanation of Item 6(b) by Mr. Butler, Mr. Wiggins moved for a RIVER BEND <br />continuance on both 6(a) and 6(b) with both items to be placed on DEVELOPMENT <br />the agenda for a future January meeting. Motion was seconded by Mr. <br />Donaldson. <br />The Chair asked if there was any discussion, whereupon Mr. John Kagel <br />said that Mr. Brownell had made a statement that he ( Kagel) did not <br />quite catch and "I hope I misunderstood him You mentioned something <br />abolit you have not deeded over to the St. Joseph River Bend Development <br />Corporation certain property, are you referring to all of the property? <br />The Chair responddd that Mr. Kagel's assumption is correct, they are <br />taking the property down in parcels. We have deeded two parcels, that <br />is al 1. <br />Mr. Kagel: Is that where Whitcomb & Keller are presently building? <br />Mr. Brownell: We have deeded the land where they are building and we <br />have deeded the land for the branch bank and gotten paid for those two <br />parcels. <br />Mr. Kagel: How about the land for the new hotel and ... <br />Chair: No, as they pay us, we deed it. Mr. Wiggins stated that "we don't <br />deed the land until we get the money John ". <br />Johii Kagel: In other words, you still own that then? <br />Mr. Brownell: That's right. <br />At his point, the Chair called for the vote and the motion carried. <br />7.
