5.(b) cOntinued- <br />Ed Bauer said that this work was done in 1971 and this was one of <br />tha first parcels to be put up for resale - before the Superblock <br />wa3 ever thought of - and the thinking was that any new construc- <br />ti n would correct the condition of the party wall by building up <br />against it. If I remember correctly, at that time it would have been <br />five or six thousand dollars to dismantle that wall and reface it <br />anJ I believe Mr. Ashenfelter, who was the Director at the time, <br />felt that it was an unjustifiable cost. At todays prices, it is <br />pr bably double that figure. Mr. Bauer also stated that they had <br />ch cked out the wall and found no falling bricks that Mr. Donnelly <br />re ers to. Undoubtedly in the last five or six years the wall has <br />de eriorated somewhat, most exposed walls would have, Whether or <br />no it becomes a real problem, we will have to determine that with <br />th Engineering Department. <br />Do Wiggins: Could that wall be sprayed with Gunite, faced over or <br />so a such deal to tie it together? <br />Mr Bauer: I believe it was at the time but that was in 1971, we'll <br />ju t have to double -check the condition of the wall. <br />Do Wiggins: Part of what I wanted to know is whether we paid the <br />co tractor to do the job and it didn't get done. <br />Mr Bauer: I've got a. meeting set for Monday morning with Mr. Sla- <br />ba gh and we will review the entire demolition contract to determine <br />if our responsibility was fully carried out. <br />Mo ion was made by Don Wiggins, seconded by Mr. Cira and carried, that <br />It m 5(a) be received and placed on file and Item 5(b) be referred to <br />st ff and the City Engineer for investigation and report. <br />M6 Cira asked regarding Item 5(a), what was the problem? <br />Wayne Brownell explained that the problem on that one is that if you <br />look at the supporting documents you will find that it was called <br />"No. 2" and they had ordered "No. 1 ", so Mr. Batchelder of Nautilus <br />is trying to get that settled for around $11,000 and thought he had <br />it settled but their attorney apparently does not agree. <br />Do Wiggins: This is a fight between these parties and we are staying <br />out of it. <br />Mr <br />no <br />to <br />Mr <br />otl <br />us <br />th <br />Brownell: We are staying out of it, I told Mr. Donnelly we are <br />going to pay anybody until they get it settled, or we get an order <br />do so. <br />, Nimtz: I told Mr. Brownell that Mr. Batchelder talked to me the <br />ier day and didn't mention this at all.
