5. OLD BUSINESS (Cont'd
Mr. Taylor stated, "I don't think that -their bid is going to be
acceptable, frankly. They have to be able to indicate that they
have some interest in the property. Of course, an option certainly
is an indication of interest, but it seems to me that there should
be a way to word this terminology so that this thing is acceptable.
I don't think that we would want to go into the detailed technical
problems." President Nimtz said, "I think this is the reason
for the meeting between you, Mr. Butler, and Mr. Brownell, to get
these resolved. Mr. Taylor stated he wished this could have been
resolved yesterday because they are so ... minimal problems.
Mr. Butler asked if the Commissioners are amenable to a special
meeting - -if, between now and the early part of next week, we can
come to some conclusion, some resolution. All responded they would
be available for a special meeting, with the exception of Mr. Nimtz
on dates of 11th and 12th of July, the dates he would be out of
town for a case in Elkhart.
Mr. Butler and Mr. Brownell are to proceed to work with Mr. Taylor
and when resolved, a Special Commission Meeting is to be called
for the discussion of the consideration of the bid on Disposition
Parcel No. 6 -1. The motion was so made by Mr.. Wiggins, seconded
by Mr. Donaldson and carried. The meeting wi''ll be public.
Ms. Jeanne Derbeck, reporter for The South Bend Tribune, asked
what is happening to Gordon Medlock's bid, and Commissioner
Wiggins said, "He didn't make a bid; he made a proposal." Mr.
Brownell advised Mr. Medlock's request was that we reject any-
body else's bid, whoever it was, and then we change the land use
so that he could bid according to his desire. Ms. Derbeck said
Mr. Medlock was very eager and he wants a chance to make a formal
bid, and that if Mr. Taylor's group gets it, then Mr. Medlock's
group will not have a chance to bid. Mr. Butler advised, "That
is something the Commissioners will have to consider when they
make their decision. We will be considering it, of course, when
we make our recommendation to the Commissioners."
Commissioner Wiggins responded to various questions Ms. Derbeck
raised, and in all fairness to her in a reporting problem, he
advised, "We underwent a lot of 'flack' here- -most of us present
are aware of - -with the bid that Associates made that had some
technical difficulties; that it could not really be accepted.
It was held on that kind of basis. We are not getting into that
again. That is what we are looking at right now."
Ms. Derbeck again referred to Medlock's proposal - -that they are
begging to bid and want to build something. Commissioner Wiggins
advised Medlock's proposal required- -not a zoning change- -but
a land -use change. They didn't want to bid under the terms
that we had the property up for bid. "Now, I can appreciate
the difficulties in this, and I would hope that everybody who
wants to get into the act, that there could be a place for them,
because we can use all the eager people that we can find, and,
hopefully, maybe - -we have some other properties - -we are not
entirely out of properties."
-6-
