Motion was seconded by Mr. Wade and <br />carried. <br />Resolution No. 513: This Resolution authorizes the execution <br />of the Redevelopment Agreement for the disposition of land and the <br />execution of Quit -Claim Deed for the transfer of title thereto <br />in connection with land to be disposed of in the LaSalle Park <br />Urban Renewal Project, Indiana R -57, for Parcel No. 28 -22, located <br />at North Chicago Street, in acquisition amount of $450.00. <br />Mr. Wiggins moved for the adoption of Resolution No. 513, seconded <br />by Mr. Wade and carried. <br />Change Order No. 1 to Rehabilitation Contract No. 14, E -7: <br />Commission approval was requested of Change Order No. l to <br />Rehabilitation Contract No. 14, with Madison Builders, Inc., <br />for an increase in contract amount of $160.00, for work at <br />1107 Carroll Street, in Project E -7, Bureau of Housing, for an <br />amended contract total of: $5,153.00. <br />The additional charge is to install three sections of 4 ft. <br />soil pipe, with appropriate accessories; excavate a 4'x4'x5' <br />area to tap into the primary sewer and fill to level; repair <br />foundation, waterproof, with concrete as needed. <br />Commissioner Wiggins said this question has come up before: <br />since this will put the contract above the $5,000 limit, does <br />the approval of this change order now require City Council <br />approval? Mr. Kevin J. Butler, Commission Legal Counsel, <br />stated he had answered this question after the last Commis- <br />sion meeting. Any contracts over the $5,000 limit or any <br />change orders increasing the contract amount over the $5,000 <br />limit must be approved by City Council, and Commission ap- <br />proval. <br />Mr. Gene Evans, Executive Secretary of the South Bend Civic Plan- <br />ning Association, raised questions on the approval of these <br />by the City Council, and also what would happen if the Council <br />would not approve the $160.00 change order in this case? Mr. <br />Butler said that is a good question.
