Mr. Brownell said this is the house where the muck caused the addition of the house to sink, which had to be jacked up and build a new foundation. Mr. Wiggins moved for the approval of the above Change Order, for an increase in contract amount of $1,402.88 for an amended contract of $8,082.88. Motion was seconded by Mr. Wade and carried. Resolution No. 513: This Resolution authorizes the execution of the Redevelopment Agreement for the disposition of land and the execution of Quit -Claim Deed for the transfer of title thereto in connection with land to be disposed of in the LaSalle Park Urban Renewal Project, Indiana R -57, for Parcel No. 28 -22, located at North Chicago Street, in acquisition amount of $450.00. Mr. Wiggins moved for the adoption of Resolution No. 513, seconded by Mr. Wade and carried. Change Order No. 1 to Rehabilitation Contract No. 14, E -7: Commission approval was requested of Change Order No. l to Rehabilitation Contract No. 14, with Madison Builders, Inc., for an increase in contract amount of $160.00, for work at 1107 Carroll Street, in Project E -7, Bureau of Housing, for an amended contract total of: $5,153.00. The additional charge is to install three sections of 4 ft. soil pipe, with appropriate accessories; excavate a 4'x4'x5' area to tap into the primary sewer and fill to level; repair foundation, waterproof, with concrete as needed. Commissioner Wiggins said this question has come up before: since this will put the contract above the $5,000 limit, does the approval of this change order now require City Council approval? Mr. Kevin J. Butler, Commission Legal Counsel, stated he had answered this question after the last Commis- sion meeting. Any contracts over the $5,000 limit or any change orders increasing the contract amount over the $5,000 limit must be approved by City Council, and Commission ap- proval. Mr. Gene Evans, Executive Secretary of the South Bend Civic Plan- ning Association, raised questions on the approval of these by the City Council, and also what would happen if the Council would not approve the $160.00 change order in this case? Mr. Butler said that is a good question.
