6. NEW BUSINESS (Cont'd) <br />Mr. Slabaugh answered Legal Counsel, "It was everybody's fault. The <br />Advisory Board, during their Christmas tree decorations...." <br />Mr. Soltesz was requesting the President's attention, and he asked <br />Ed Soltesz to wait, as Mr.. Wilcox is shaking his head, and saying <br />'No'.to that. Mr. Wilcox said he wants'to defer answering that <br />to Soltesz, and the Chair gave Mr Soltesz''permissi'on to speak. <br />Mr. Soltesz's comment, "Mr. Colip suggested - -Mr. Charles Colip <br />suggested - -in that letter that you (directed to Bill S1abaugh') have, <br />and in conversation to it and in addressing to that, that covers <br />could be utilized of some type to cover those pools. Now, the <br />cover that was used on that pool was negative; it was constructed:: <br />Insofar as covers on those pools, 'yes,'they should be there, to <br />negate the fact of throwing things in it." <br />"My comments as to the pools by the old post office--with the open <br />grates - -many people that have walked through 'there `have caught <br />their heels on it, and we are liable for suet in the City-- TODAY -- <br />because of the open gratings that are on it. (Commissioner Wiggins <br />agreed). There have been suggestions made on this, and it has NOT <br />been followed through with EITHER: Mr. Wilcox has made this pre- <br />sentation; it has been brought beofre the Board HERE, and at the <br />ADVISORY COMMITTEE MEETINGS AT THE RIVER BEND PLAZA, AS TO WHAT <br />HAS TO BE DONE: THIS HAS NOT BEEN IMPROVED UPON AT ALL:" <br />"The point here, Gentlemen, is this: We have people that are in <br />charge of the maintenance of these pools NOW, that are not aware <br />of the job and the responsibility they. have in maintaining them. <br />This is what it amounts to. To the tune of money- -yes, we have <br />the money to pay for these things - -but, surely, somewhere along the <br />line, there should be a brochure out to give to people that are in <br />charge, to maintain those items that we have to supplement with <br />'M 0 N E Y S' -- moneys:" <br />The Chair, at this point entertained a motion that this matter be <br />referred to Legal Counsel for discussion with the Board of Public <br />Works and Safety, the City Engineering Department, and report back <br />at the May 23rd meeting. Also with Colip's. Commissioner Chenney <br />said, "I thought Kevin Butler just said that it is our responsibility: <br />Now, listen, this here...I want to speak on this: This has nothing <br />to do with ...Colip Brothers installed it in the first place, didn't <br />they? According to the engineers' specifications? "Yes, sir," <br />was Mr. Slabaugh's reply -- "Yes, it was according to the plans and <br />specifications." Commissioner Chenney asked, "And we found out <br />that it didn't work, that moisture gets in there--the water gets <br />in there." Mr. Soltesz said, "It was a neglect. with Mr. Chenney <br />stating, "That's all right; THAT'S not Colip's fault!" Mr. Soltesz <br />answered, "That's right; You are absolutely right'" Mr. 'Chenney <br />said, "and now that you got Colip to go ahead and try to fix it, <br />and he recommended what we do, and now you don't'want`to pay him, <br />right? Mr. Chenney said he makes that recommendation right now <br />that Colip be paid; he is not going to turn it over for the future. <br />- 26 - <br />
