6. NEWIBUSINESS (Cont'd) <br />comment was, "Well, then I stand to be corrected. I understood <br />from this Commission that sometime in the last several weeks that this <br />has been turned over -- including the $6,000 that was appropriated for <br />cleaning these pools., last Januarys by this Commission." Mr. Slabaugh <br />replied, "Co.ntract'No.' 5 is still an active contract! YOU SAW to that <br />when you nailed that $8,000.00 down in the Hickey contract. Hickey <br />still ownes that pool that you are speaking of down there." <br />The Chair requested that this be cleared, and asked Mr. Brownell, "Are <br />these the City's responsibility, or are they ours? Mr. Brownell <br />said they he understood that they have been turned over to the Board <br />of Works and the Chair said that was his understanding also. Mr. Slabaugh <br />said, "That is not true, unless you have turned it over since last Monday." <br />Mr. Brownell said that he had talked to Mr. Farrand about it. <br />Mr. Butler, Commission Legal Counsel, stated that his understanding is <br />that the, Commission has never approved that Contract No. 5 - -a completion <br />certification - -or that a comparable document has never been approved <br />by this Commission. And if that isn't correct? Mr.` Brownell replied, <br />"That's right. In other words, there are still some maintenance items <br />for Hickey to go over. In fact, we held back $8,000 to guarantee that those <br />would be delivered; and, therefore, we have do not have a completion on <br />that. Commissioner Wiggins' response, "All right, if not completed, then <br />can it, in fact, be turned over ?" Mr'. Brownell said that we have tried <br />to turn over the operation of the fountains to the Board of Works is over <br />the Plaza authority. The Chair responded that by now, they lost him in <br />the understanding and he still didn't know, "Are they the City's responsi- <br />bility, or are they ours? Because when Ed talked to me the other day, I <br />said it was the City's responsibility." Mr. Brownell said he understood <br />in talking to Mr. Farrand, that the Plaza Authority, which is appointed <br />by the Mayor - -the same as the Board of Works- -had taken control of and <br />were operating the fountains in the Plaza." Mr. Butler replied to Mr. <br />Brownell's comment, "I think the legal responsibility is ours; we have <br />the responsibility under the contract." President Nimtz said, "Well, <br />then I was wrong when I said that to you the other day (speaking to <br />Mr. Soltesz)." <br />Mr. Soltesz said that it is quite all right and that it kind of clears the <br />air. "Then, I am going to ask, "What happened to the $6,000 in chemicals <br />that.was to be used along with a steam cleaning unit that was appropriated <br />by this Commission, awarded to the Board of Public Works, and to the <br />authority of Mr. Slabaugh for the cleaning of these pools ?" Mr. Slabaugh <br />replied that they are in use daily. The chemicals and all, as they cannot <br />all be put in the pools at one time. <br />Mr. Soltesz replied that he is not playing 'Monday morning quarterback' <br />with this thing, because of the fact that, "I told'you so.' I have been <br />standing before this Commission and before.these meetings many times talk- <br />ing about these pools. Now, I received the last phone call on the pools <br />not operating and the way that they look. We spent quite a bit of money <br />on the pool by Jefferson Boulevard that has the black stones. I don't <br />know whether they came from'the Hudson Bay area, or where they came from, <br />but the people that designed these pools., 'it was 'a thing of novelty!' <br />Now the pool in itself is not ' black' - -it's gray.'
