6. NEW OUSINESS (Cont'd) <br />Mr. Slabaugh stated, "I said, 'if' and the 'if' was- -and Helen wrote <br />it down in the Minutes with a 'big if.' We had a three-year warranty, <br />which we are trying to guarantee here: <br />Response from Mr. Soltesz,' "Well, -you see, warrantees are tike anything <br />else, and this was my point t: Now, we have a figure here of $2,600.00. <br />In this $2,600.`00, the employees - -your employees= -AND my witness is <br />sitting right in this room, and we WERE TOLD to remove the covers off <br />of these same fountains, that are now being talked about by Colip in <br />his letter--Charlie Col'p wrote the letter--and also the other letter <br />that you speak of - -1 have copies of BOTH- -and in there it was specifi- <br />cally stated that the instructions were not followed.in the preparation <br />of the pools. Now, there was not a determination..... <br />Mr. Slabaugh: "This is NOT a Hickey Contract::" Mr. Soltesz: "I didn't <br />interrupt YOU:, Mr. SLABAUGH, when you had the floor: Mr. Chenney: "You're <br />getting a little rough, boys: <br />The Chair said "All right, go ahead." ...to which a heated rebuttal <br />ensued. Mr. Slabaugh stated, -I am the Project Engineer, sir. I am in <br />the Redevelopment area:" and Mr. Soltesz's retort was, "AND I happen to <br />be the taxpayer, Sir; JUST remember that:" The Chair's gavel to maintain <br />order in the meeting was ignored, with more heated rebuttels. <br />The Chair requested Bill Slabaugh to complete his report. Mr. Slabaugh <br />said "this was not a Hickey contract. Hickey is the general contractor <br />on Contract No. 5; Colip was their subcontractor. But Colip put these <br />pools in order so that they run and so that they can be under warranty. <br />Actually there was one part that was stolen; one of those pool lights was <br />stolen and that's in here.. It is not indicated in the detailed breakdown; <br />it will be in his bill, so, if we are saying that Colip shouldn't be paid; <br />if that is what is coming from the outside, you recognize as someone who <br />is not completing my report, then all I am doing is asking for your ap- <br />proval to pay Colip for the work that they DID to insure that we would <br />have a Maintenance bond, which we will probably lose if it wasn't done." <br />The Chair asked Bill if he is through now, and Bill Slabaugh said he is <br />through if that's all that is required for him to explain. <br />President Nimtz said the Commissioners had no questions at thE! time he <br />had called for the Commissioners' comments, and '°Do the Commissioners <br />have any .comments now ?" Commissioner Chenney asked if Colip's have done <br />the work, to which Mr. Slabaugh answered, "Yes, Sir." and Mr. Chenney <br />said that is all he wanted to know. The Chair requested Mr. Soltesz <br />to go ahead with his discussion. <br />Mr. Soltesz commented; "No. 1, to clear the air. I have no objection <br />to having the pools running. We've.got $3 Mil -lion Dollars invested; a <br />little better than.$3 Million, in fact. The citizens of this community <br />would like to spend some time in utilizing these little pools from the <br />time that they were turned on and they were not completed;.were not <br />operating. I understand that they have been turned over to the City in <br />the interim. Who......" Mr. Slabaugh interrupted., "They have not been <br />turned over to the City in the City in the interim."
