NEW BUSINESS (Cont'd <br />All rehabilitation contracts in the E -7 Project, Bureau of <br />Housing, over and above thE; $5,000.00 limit must be ap- <br />proved by the South Bend Common Council. <br />Contract No. 42: <br />Also, Commission authorization was requested to award <br />Rehabilitation Contract No. 42, to Barany Heating & Sheet <br />Metal, in bid amount of $4,500.00, for rehabilitation work <br />at 221 East Pennsylvania, and the President and Secretary <br />authorized to enter into a contract, subject to approval <br />by Commission Legal Counsel, per recommendation of the E -7 <br />Advisory Committee. <br />On motion by Mr. Wiggins, seconded by Mr. Chenney and <br />carried, Rehabilitation Contract. No. 42 was awarded to the <br />low bidder, Barany Heating & Sheet Metal, in bid amount of <br />$4,500.00, and the President and Secretary authorized to <br />enter into a contract, subject to Commission Legal Counsel <br />approval. <br />Rehabilitation Contract Nos. 16, 20 & 31, E -7: Approval <br />was requested to rescind the conditional award by the Re- <br />development Commission of Rehabilitation Contract Nos. <br />16, 20 and 31, to American Home Improvement, by the Com- <br />mission on February 7, 1975, and the Common Council on <br />February 10, 1975, and also contingent on Commission Legal <br />Counsel approval, as the owner of the firm, Mr. Stanley <br />Walczak, has informed Mr. Keith P. Crighton, Director of <br />Bureau of Housing for the E -7 Project, that he is unable <br />to comply with the performance bond regulation for the <br />Southeast Rehabilitation Program, E -7. <br />Ms. Jeanne Derbeck, South Bend Tribune Reporter, raised the <br />question in action of awarding the contracts, whether Stanley <br />Walczak, as an employee of the County Building Department, <br />was not in conflict of interest, if that thought didn't <br />enter the Commissioners' minds? Mr. Brownell advised at <br />the time these contracts were awarded, Mr. Walczak was not <br />working for the County. Mr. Keith Crighton, Director of <br />Bureau of Housing, E -7 Project, further advised that Mr. <br />Walczak was not awarded any contracts for any project at <br />that time. The contracts he was awarded were "prior to Mr. <br />Walczak's employment with the County." <br />As to the statement by Ms. Derbeck that she has had evidence <br />that Mr. Walczak was doing the work while he was an employee, <br />Commissioner Wiggins replied to the comment that this would <br />be in the area of limiting a worker from working on more <br />than one job and the control that may be placed on this. <br />There are people working for the City who are also working <br />on another job.
