OLD BUSINESS (Cont'd) <br />Mr. Butler requested a motion to approve the purchase <br />of the decorations and to authorize the President <br />and Secretary of the Redevelopment Commission to enter <br />into an Agreement with the River Bend Plaza Foundation, <br />Inc., in an amount not to exceed $30,000 (per Exhibit <br />"A "), to be paid in three equal installments each on <br />July 1, 1975, 1976 and 1977. <br />Said motion was made by Mr. Wiggins, seconded by Mr. <br />Wade and unanimously carried. <br />d. Lawson Associates Contract: Mr. Kevin J. Butler, Com- <br />mission Legal Counsel, advised the Commission had author- <br />ized a contract with Lawson Associates for the planning <br />of the design and construction of the St. Joseph River <br />Corridor.generally on the west side and in the St. Joseph <br />River from the old.Oliver Powerhouse to LaSalle Street. <br />There was rather extensive discussion of this matter as <br />related in the minutes, with authorization for a contract <br />in lump sum not to exceed $3,000. The authorization was <br />also to approve the advertising with the Board of Works for <br />a construction contract not to exceed $40,000 -- subject to <br />HUD, Legal Counsel review and approval by the Board of <br />Works. <br />Compensation "4 -1 ", Scope of Services shall be $3,000; <br />"4 -2 ", Engineer's Additional Services (eleven service <br />items, if authorized in writing by the LPA, to be paid <br />for at a fee to be specified in writing);and <br />no case shall the Engineer's Basic.Fee plus specifically <br />authorized "additional services" exceed Three Thousand, <br />Five Hundred ($3,500.00) without prior written authoriza- <br />tion from the LPA and in no instance shall services re- <br />quired of the Engineer exceed this restriction. <br />A lengthy discussion followed with the interpretation be- <br />ing the additional services, if requested by staff, would <br />result in an additional cost in amount to $3,500.00, plus <br />the $3,000.00 previously agreed to - -or a potential exposure <br />under the contract of $6,500.00. <br />LAWSON ASSOCIATES <br />CONTRACT AUTHORIZEI <br />NOT TO EXCEED <br />$3,500.00, R -66 <br />In reference to Commissioner Wiggins' question on who deter- <br />mines what work will be required, and Mr. Gene Evans, repre- <br />senting South Bend Civic Planning Association, if our staff <br />is authorized to issue change orders now without going through <br />Commission approval, Mr. Wayne Brownell, Acting Deputy Direc- <br />tor, said this is being requested by staff; however, the Com- <br />mission should be aware this exposure is there, as it may be- <br />come necessary to do some additional work and we need authori- <br />zation to have it requested to be done. The cost of the con- <br />tract will be between $30;000 and $40,000. As to the deter- <br />mination of the work, Mr. Brownell said we will rely on Lawson <br />Associates and our City Engineering Department, who will do <br />W:0 <br />
